Thank You, Keith Walker Moab, UT 84532 Dear Jim, Interesting news in Grand County this month regarding die dreaded "Scenic Overlay Zone". It is amazing the degree of misunderstanding this "proposed" item has caused. This zone would have been passed in concept but not in ordnance if the old commission had accepted the modified Master Plan they requested. The entire plan was tabled relative to the change in government. The recent upswing in development is driving the need for a current modified Master Plan as a priority. The old plan was developed during our bleak economic years and it's focus was economic development. Our current focus has shifted to orderly sustainable growth. After numerous discussions with regional planners as well as local input for master plan development a challenge was recognized. How best to deal with zone change requests in historically stable agricultural land. Owners of A1 (agricultural) and Cl (grazing) zones are requesting rezoning to R1 (residential) or Cl (commercial). When a community is originally zoned, it is hoped that the forefathers have made wise choices to the proper mix of residential, commercial and agriculture land for present and future use. Though we have available residential and commercial pa reds, developers desire to rezone lower priced land for a new use. Windfall for the agricultural land owners, bad for the residentialcommerdal land owners. While there may be some justification for this change, the problem is that the R and C zones were designed primarily for urban areas while the A and G zones are more rural. It is not a smooth fit to place urban zones on rural areas. Problems arise with those that choose a rural life style originally and do not desire a regional zone change. There is a compounding factor to this problem. The majority of A1 and G1 zoned property requests are next to the Colorado River, or highway 191, bounding our National Park entrances. This land is also very beautiful and unique. The river and scenic highway corridors are a major source of income from tourist dollars and filming for the area. Large scale development in these areas may have negative impacts for the majority of the citizens yet might allow increased prosperity to those who choose to sell this land for development. The problem is to weigh personal rights with public good. Now for the scenic overlay zone. This was borrowed from other communities with similar considerations like Sun Valley, Jackson Hole and Aspen Roaring Fork Valley. This Scenic zone could be a new customizable zone. It might be requested with a zone change, with covenants tailored to the land. The idea is to allow the rural land owners desiring to sell their land for a different use then it has been historically zoned, an option. It allows the rural quality to be maintained for those who desire to keep their property. It could also allow wise sustainable growth with a healthy economy to continue.
