Show PAGE 29 THE ZEPHYR APRIL 1993 House Bill 171 (Rep Met Johnson, Washington) Private Property Protection Act This bill requires that a State agency determine if regulations they create would take away a property owners ability to use that land. A similar bill in Arizona has created numerous law suits and cost residents of the state untold numbers of dollars. The bill was amended and weakened at the last moment. It will take some time before State Agencies will know the impact of this new law. Several bills were introduced involving State School Trust Lands. All either failed to get past rules or make it out of committee. The Cowboy Caucus was not content to just pass legislation aimed at managing the State's wildlife. It also set about slashing over $650,000 dollars of General Fund monies from the DWR's budget. This leaves only 1 of DWR monies coming from the general population of Utah. The other 99 of DWR's budget is from the sale of hunting and fishing licenses. The DWR is mandated by law to protect all the wildlife in the State. DWR had been trying to develop programs for nonconsumptive uses of wildlife. They were trying to get away from being a "Hook and Bullet" agency and more toward managing and protecting all wildlife. The Cowboy Caucus felt that by enforcing the endangered species act and protected habitat for other rare wildlife species DWR got in the way of their rural interests. One final note on the Legislature. A small bill was introduced into the Senate by Senator Mike Dmitrich (Carbon, Emery, Grand, San Juan, Kane, Washington). The bill simply stated that some operations would be exempt from state redamation regulations. This little bill stir a raised quite throughout the State. It seem Sen. Dmitrich had a constituent who violated the rules required by Oil, Gas & Mining while mining for day. The bill was designed to reduce "overregulation by State government. Ibis would have left hundreds of day pits dotting the landscape with no reclamation required once mining was completed. The state's brick industry was against the bill. They believe reclamation is the right and responsible thing.
