september 1st ast at about 10 a in in the month of may lie he became ill III and tor for a number of 0 weeks was confined to his bed bad ile he recuperated sufficiently however to get out and around although his strength had been sorely taxed by the illness brother bywater took up his abode with his son in law charles W allson on down on the farm july 28 in the hope that he could be surrounded with quietness and receive good nursing he got along nicely until the of august when he wa was stricken again and forced to go to ed from that time he has failed rapidly until the end came and death released him A brief sketch ot of his life as recoil ed by himself was furnished by anem members of his family and is as follows james bywater was iorii b orn august 23 1823 in holbeck yorkshire england at the age of nine years he was employed in a flax factory remaining there tor for 14 years on august 14 1848 lie he left liverpool for america arriving here after a long voyage and the following year accepted employment as a on the wisconsin and mississippi rivers in 1851 while down on the gulf of Al mexico exico mr bywater met a mr a mormon in conversing with this gentleman brother bywater received a testimony of the gospel ot of jesus christ of 0 latter day saints and the divinity of the calling of 0 joseph smith he was baptized on feb 4 1852 in the leeds and liverpool canal by joseph wharton president of the leeds branch of the church in june of the same year he again agahi set sail for america in 1855 lie he joined erastus snow and company at st louis journey in ing with them to salt lake city they aref arrived vea september ard 3rd elder bywater paid the passage of several saints from st louis to salt lake city shortly after his arrival in utah he came to brigham city passing through that terrible winter of 53 when the settlers here endured untold suffering and hardship brother bywaters first labor in brigham city was that of making adobes acobes in connection with george B reeder and william metcalf on july lie he married marla maria thomas who has borne him ten children 8 of whom still live during that ummer summer he was appointed county clerk county recorder and a notary public was also made an adjutant of the regiment of 0 militia militia which was then organized here upon the organization of the quorum of seventy in 1858 james bywater was made clerk in the winter of 62 lie he was made tithing clerk in which capacity lie he labeled tor for some time in 1871 he built the bywater home in III the second ward and on maich two years later lie he was married to hannah M jen aen en accepting the principle of plural marriage by his second wife he had eight children five of whom are still living his loving wife passed into the other life march etli 1905 in october 1873 1 brother bywater was called to go on a mission to england being set apart under the hands of president wilfond woodruff joseph F r smith and george Q cannon and labored there here until october 14 1874 when he was wa released to return home on account of ill III health upon arrival at home he was engaged in the mercantile department of af the coop co op store end and labored there for a number of years when the box elder stake was organized september G 1877 james bywater was appointed clerk and his torian as well as a member of the high council in 1878 he was appointed deputy probate county bleik and before the end of the year was elected county bleik and recorder in 1882 by reason of the edmunds tucker act he was removed from office and on july 12 1887 was arrested by U S mariallis Mars Mar ahls sallis steele and whetstone on oil the charge of polygamy next year his case came up for trial and on may 0 28 8 he was sentenced to lo pay a fine of 50 and spend six moll months in III the ary for unlawful cohabitation he went to pilson and served his sentence being released nov 28 1888 on june 19 1889 he be was arrested a second time on oil the same he e was set apart as a special missionary to england I 1 ahert where he labored tor for one year and was released on account of ill health in october of the same year he was arrested the third time by U S marshal mcclellan who treated I 1 him i rather roughly this time he was sentenced to two jears imprisonment for adultery and six months for unlawful cohabitation with costs of the proceedings edings this sentence was corn com muted by president benjamin harrison of the unites states to one year actual imprisonment and pay a fine of actual costs this was done and for the third time brother bywater took up his abode in the state prison spending altogether a little over two years in that institution for conscience sake these persecutions together with his missionary experience reduced ir his finances and brother bywater was wa placed in straightened tightened circumstances which fact weighed heavily upon him in ISO 1905 he succeeded in paying the last fart farlling ling of his obligations and lie he died owing no man a dollar ills family who survive him consists of a wife 13 children 54 grand leholden childen arid and 2 great g grand rand children bes besides idesa a host beautiful and appropriate music was furnished furnish ed by the ward choir unusually sad is the demise of charles ar jensen which occurred wednesday morning at 21 mr air jensen has been ill for about ten days with the dreaded disease typhoid fever he made a brave fight but w was as not able to overcome the ravages of f the disease the passing of mr jensen is air the more sad because of the bright prospects which seemed to hold out encouragement to him for the future married but a few months his death has left a heartbroken heart broken young wife and a life that gave every promise has been closed another sad feature connected with the death of mr jensen is the fact that he is the fifth in his fathers family who have been claimed by typhoid fever his hii mother died 15 years ago last april from a complication of brights disease and typhoid fever while three children brigham genie and lizzle lizzie were victims of the same trouble another little baby brother died in infancy mr
