Show County man to face sentencing in death of daughter By GARY R. BLODGETT FARMINGTON A sentencing sentenc-ing hearing for a 25-year-old man who pleaded guilty to second-degree second-degree murder in the death of his infant daughter last August has been set for Feb. 3 in Second District Dis-trict Court. Gregory W. Rogers, 31 W. 1600 N., Sunset, pleaded guilty as charged before Second District Court Judge Douglas L. Cornaby, Rogers was to stand trial for the alleged murder of his seven-week-old daughter, Caitlin Rogers. Defense Attorney Randine Salerno told Judge Cornaby that the plea was entered so that her client would avoid a lengthy, painful pain-ful and very difficult trial. . Also stipulated in the plea was that the original charge of first-degree first-degree murder be reduced to a second-degree felony with a possible possi-ble prison term of one year to 15 years in the Utah State Prison. A firfct-degree murder charge carries a sentence of five years to life. Judge Cornaby said he would consider the plea stipulations but emphasized they would not be binding if he feels they are not warranted war-ranted . The hearing for the reduced charge has been set for Feb. 3. Rogers was arrested by Sunset police after telling conflicting reports re-ports of how the infant was harmed on July 3 and rushed to Primary Children's Medical Center. The baby died Aug. 7 without regaining consciousness. An autopsy disclosed that the baby suffered swelling of the brain and other injuries, including broken ribs and a broken arm. Lt. Phil Olmstead of the Sunset Police Department testified that Rogers told him two conflicting stories about how the injuries allegedly occurred. Lt. Olmstead said Rogers once told him the baby fell from his lap while eating, striking strik-ing her head. Later the defendant said "he shook the baby a little, but did not intend to harm her." |
