Show FIRST DISTRICT COURT opening of the term CASES DISPOSED OF AND GRAND JURY strange and peculiar questions put to the juror the district court for the february term began yesterday at 2 his honor judge H P henderson on the bench of the bar there were present J E booth A G sutherland D sutherland A wy ry and B W driggs jr of provo and 0 W powers or Ogden also clerk H H henderson and deputy clerk B bachman jr there were several matters of business connected with the late november term disposed of before the opening of the new term was formally announced among which were alie following A motion in the case of the united states against francis L patterson recently indicted in ogden for fornication was offered and argued by judge kofl era for placing alie cause on the calendar of this court the motion was opposed by D evans assistant district i attorney and taken under advisement by the court thomas fowler was sworn in as court crier and A W laird and H L evana as bailiffs it was ordered that sheriff john W turner be in daily attendance on the court during the term in the case of the people against E L gee it was ordered that the marshal bring defendant from the penitentiary into court on monday next in alie case of nathaniel williams against E T jone it was ordered that constable F E grames be authorized to papers on defendant at this stage the court was formally opened for the ensuing term an order was entered for the bringing i into court for trial on monday next from the penitentiary of hyrum K polk charged with grana larceny the case of E brereton vs N C larsen was set for monday evening next the court then adjourned until tuesday at 10 a m this morning business of the court commenced by em paneling of the grand jury following persona were called newell knight peter Ad aroson adam sandberg B V brown joseph smith lester taylor james crookston bobert A hills andrew peterson lars 0 lawrence lyman S hudson geo W jacques chas W middleton lidd leton james barton and cyrus sanford jr examination on behalf of the prosecution was conducted by D evans abst diet atty knight adamson and sandberg were accepted B W brown I 1 ho boeer eer failed to keep his seat he admitted he ft as a member of the mormon church had recently been on a mission preached the doctrines of the church believed however that the I 1 doctrine of polygamy was wrong had not formed any particular opinion as to the divinity of the revelation believed the laws against polygamy etc should be obeyed on his mis sion he had preached the gospel as laid down in the bible the court As robert A hilla andrew jpe tereon and lars 0 lswrence were examined and passed lyman S hudson wis next examined closely as to his belief and the state of his conscience on religious questions believed the laws forbidding the practice of polygamy should be enforced though he had faith inthe doctrines of the mormon church the laws of the land should be supreme this juror for the present geo W jacques was examined and accepted charles W middleton in his examination avowed hia fellowship with the church did not believe it ight ta yio late existing laws where there was no law it might be right to practice plural marriage he was thereupon challenged in answer to mr geo sutherland middleton said that although he might bekele in the principle pla of plural mar riale he did not believe it right to practice it in violation of existing laws and avowed his readiness 0 o convict persons guilty of such violation mr sutherland denied the challenge on behalf of a number of his clients whose cases would necessarily have to be examined by this grand jury the challenge was however sustained by the court and middleton was excused jamaca barton was next examined and accepted cyrus sanford jr in his examination believed it wrong to practice the doctrine only when there was a law against it challenged to mr sutherland juror stated that in his opinion a man should be punished when he violated the polygamy law as be should be when he violated any other law he would convict a man for polygamy on the same measure of proof ag would be required in a larceny case the challenge was denied but the court sustained it JOB E tibbets andrew and henry E Baw lingi were called to take the places oft bose excused tibbitts was found acceptable and took the oath madsen ws a member of the church did not believe polygamy was right however think he had ever read the revelation and could not say that he had formed any opinion in relation to it if there was no law against the I 1 doctrine and society and accepted u adjourned until 2 this afternoon at reassembling the of court n the business of em paneling the grand jury was resumed rys umed r mr evans renewed examination of thu two mormon jurors hudson and but they passed the ordeal successfully and were accepted new ell knight was appointed foreman and sworn in the grand jurors were then as a body sworn by his honor proceed eato them as to
