Show $5 A MONTH NOT ENOUGH Aged Woman Sues for Fulfillment of. Contract to Support Her. August Nelson was today made the defendant In a suit filed by Cecelia Anderson, An-derson, SO years of age, who seeks to set aside a deed to a parcel of land in this county containing thirty-four acres, executed ex-ecuted by plaintiff in favor of John J. Olsen, the stepfather of the defendant, on January 29, 1895. The petition alleges that the heirs of Olson have failed to Carry out .the agreement of the sale. The plaintiff sets out that the conveyance convey-ance of the land was made to Olsen in consideration of $1000 and upon the further written consideration that he or his heirs would support plaintiff during the rest of her days. Olsen died in 1896 and the property was distributed by the court to his wife. She transferred the property to her son, the defendant Ic this case, without any valuable consideration. It is alleged that since that time the plaintiff has not been properly provided for, though the defendant- has offered to pay $5 per month for her support, provided she would release all claim on the property The plaintiff states that this amount Is not sufficient and asks the deed of conveyance be declared null and void, and that the court issue an order restraining re-straining the defendant from disposing of the property. |
