Hempstead moved that the trial bo continued to,the March term. Tho prosecuting attorney objected to this, remarking, we only know through tho public newspapers Hint he has passed beyond tho jurisdiction of tins Court, or at least, out of this Judicial District, when he is under recognizance here to appear from day to day and not depart the Court svithout leave. If the gentleman desires a contlnuanco In that case I will demand a showing oiv affidavit. Mr. Hempstead rejoined that his client was not absent, and did not tntond to absent himself from tho Torritory, but being in ill health ho had gone south, as had been his custom for several years past; and further, on this occasion he had gone with the entire approval of his counsel, and whenever the case might be set for trial, ho (Brigham Young) would be personally present In Court to answer any and all charges that might bo brought against him.
