Tho efforts oil tho part o the Oregon officials to get Tinny and Loora Morgan Mor-gan out of tho Stato of Utah will probably prob-ably bn as fiercely contended against us any efforts heretofore made to got tho alleged fugitives from justice out of the( Slate. Tho Morgaus aro charged with being implicated in a $10,000 robbery in Portland. Port-land. Thoy were chased about 12,000 miles over the country by Detective Joe Day of Portland. and" finally run dowu in Salt Lako. They encaged tho services of King, Burton & King, and S. A. King of that firm applied to Juclco Armstrong of the Third District oourt for a writ of habeas corpus, on the ground that tho Morgaus were beiug held without any warrant of arrost. Tho writ was granted and after hearing tho nrgumonls on Thursday t Judge Armstrong Arm-strong dismissed the pVisoners. They wore immediately rearrested by Sorgl. William llilton on a warrant charging them with being fugitives from justice. Later they wore taken bpforo Judgo Diehl and arraigned. They pleaded not guilty and wero placed undor $2500 .bond3. and wero turned over to tho Sheriff and taken to tho county jail. In the meantime the requisition pa-pors pa-pors of the Governor of Oregon had arrived. ar-rived. Attorney King examined the papers and applied lo Judgo Lewis for another writ of habeas corpus, on the ground that tho requisition papers wero faulty iu that the affidavits contained in them did not show that Harry Morgan Mor-gan had any direct connection with tho robbery, and, in fact, did not show that ho had oven been in the Stato of Oregon Ore-gon at tho lime tho robbery is said to have been committed. Judgo Lewis granted tho writ of habeas corpus and Sheriff Emery is directed to hnvo tho prisoners in court this afternoon at 2 o'clock. Last night Gov. Cutler, Attorney-Gon-cral Brccdcn, Detective Day mid At-lorno' At-lorno' King met in tho oflico of tho Govornor, and the Governor intimated that ho might possibly honor tho papers today if Detective Day would amend tho papers bv an affidavit setting forth the information on which Attorney King contends that they aro faulty. Mr. King contends that this would bo an improper procedure and that the only proper method would bo for the papers to go through tho hands of tho Governor of Oregon agnin for any changes that aro to bo made. |
