OFFENSIVE OF-FENSIVE LIQUID, AND REFUSE; RE-FUSE; PROVIDING REGULATIONS REGU-LATIONS CONCERNING DISTRIBUTION DIS-TRIBUTION OF MEDICINE AND PROPRIETARY PREP ARATIONS; PROVIDING REG U L A T I O N S CONCERNING STAGNANT WATERS AND DECAYING OR OFFENSIVE SUBSTANCES; PROVIDING REGULATIONS CONCERNING CULINARY WATER AND PROVIDING REGULATIONS CONCERNING THE GENERAL GENER-AL HEALTH AND WELFARE OF OREM CITY AND THE INHABITANTS IN-HABITANTS THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF OREM CITY, UTAH: Sed'on 1. There is hereby created and established within and for the City of Orem, a Board of Health with powers and duties as here inafter set forth and which, to gether with its officers and employees, em-ployees, shall constitute the Health Department. ARTICLE I. ORGANIZATION Section 1. The Board of Health shall shall consist of either the Mayor or councilman who is in charge of public health, who shall be an ex officio chairman of said Board, the Health Officer, and five representative citizens. The Mayor Orem City shall appoint the members of the Board of Health which appointment shall be confirmed by the Orem City Council except the councilman rr Mayor in charge of public health who is an ex officio mem ber, all of whom shall serve without compensation. Section 2. The meetings of the Board of Health shall be held once each month on a day to be determin ed by the Board of Health PROVIDED, however, that special meetings shall be called at any time by the Chairman upon request of two or more members of the Board. Section 3- Duties and Powers of Board of Health The Board of Health is hereby empowered to enforce all ordinances ordin-ances of Orem City, and all laws of the State of Utah now In force or that may hereafter be enacted, relatng to the produc tion, manufacture, st o r a g e , keeping and sale of meat, meat food products, food products, dairy and creamery products, the adulteration of any article of food, the use of all food pro ducts, the housing, keeping, feeding and caring of animals, the products of which are or may be utilized as food products; prod-ucts; the quarantine and disposition dispos-ition of all animals affected with any contagious or infec tious diseases, and in general to do things proper or necessary for the preservation of the pub lic health and the elimination, prevention or restriction of disease. The Board of Health shall make all needful rules and regu lations for the proper and successful suc-cessful operation of the health department of the City of Orem, and for the preservation of public pub-lic health, and shall exercise general supervision over the health, sanitation and cleanliness cleanli-ness if the city; the board shall have and exercise general super vision over the production, manufacture, man-ufacture, storage, keeping and sale of all food products, and effectuate all measures necessary neces-sary for the prevention and elimination of disease, the prevention pre-vention and abatement of nuisances, nuis-ances, and for the proper and prompt performance of such other duties as the said department depart-ment may be required to perform per-form by the laws of the State of Utah, the ordinances of Orem City or for the preservation of public health, and recommend to the Orem City Council such health measures and ordinances as from time to time it may deem necessary. Section 4. Registrar of Vital Statistics. Fees. The Orem City Recorder shall be ex officio registrar of vital statistics. The Orem City Coun cil may, in their discretion, ap point one or more deputy registrars regis-trars of vital statistics who shall have the same powers as the Orem City Recorder in the registration regi-stration of vital statistics. The registrar of vital statistics shall be provided with a oeal containing the words, "Registrar of Vital Statistics, Orem City, Utah." Said seal shall be affixed to every certificate issued by said officer and a fee of $1.00 shall be charged for each certificate certifi-cate issued. Section 5. Health Officer. Appointment. The Orem City Council at the time and in the manner provided pro-vided by law, shall appoint some suitable and competent person to the office of Health Officer, who shall qualify and hold office of-fice for a term of two years-Section years-Section 6. Police Power. All officers and inspectors of the Board of Health shall have all rights, duties and obligations of policemen to enforce all laws of the State of Utah, ordinances of Orem City, and the rules of-the of-the Board relating to the general health of the city. Section 7. Quarantine Limits. Orem Cltr, rr.d all that district dis-trict or country embraced within with-in one mile of the outer limits thereof, and not included within the proper quarantine limits of any other city, is hereby declared declar-ed subject to -quarantine regula 'ions, and the Health Officer is hereby declared to be the Quarantine Officer. Section 8. Quarantine, Board of Health Mav Declare. The Board of Health may de clare quarantine in the city or any part thereof against a con- lagious or infectious disease pre vailing there or elsewhere, and against all persons and things likely to spread contagion or infection, in-fection, The Board of Health shall have authority to enforce such quarantine until the same is raised by it, and may confine any person affected with or likely to spread contagion or infection, in-fection, to the house or premises in which he resides, or to a place provided by the Board for that purpose. Section 9. Right to Enter Premises. The Board of Health or any duly authorized representative thereof is hereby empowered, when it shall be deemed necessary neces-sary to secure or preserve the public health, to enter into or upon any premises, building or other place, or of any persons occupying the same or working 1 herein or thereon, and also to examine, analyze or test any products or-goods manufactured, manufactur-ed, stored, kept for sale or offered of-fered for sale upon or in any building or premises, and if, after af-ter such examination, analysis or tests, such products or goods shall be found unfit for human food, or unsanitary, to condemn or destroy all such foodstuffs, goods or products-Section products-Section 10. Sanitary Regulations of Certain Businesses. The Orem City Board of Health may adopt reasonable rules and regulations prescribing prescrib-ing sanitary requirements for medical practioners, dentists, pharmacists, barber shops, barber bar-ber schools, cosmeticians and beauty shops, and cause such rules and regulations to be printed in suitable form and transmit a copy thereof to each registered medical practioner, dentist, pharmacist, cosmetician, adn proprietor or manager of a barber shop, barber school or beauty shop. Section 11. Food Inspector. Duties. The Health Officer shall, under un-der the direction of the Board of Health, have charge of the meat and food inspection, and shall perform the duties prescribed pre-scribed by law and ordinance, and such other duties as may be assigned by the Board of Health- ARTICLE n REGULATIONS FOR PHOC ESSING, HANDLING. AND SELLING OF MEAT AND Section 1 Inspection of Places of Business. Orem City Board of Health Mav Reyoke License. In cases where the Health Officer Of-ficer on such inspection shall determine de-termine that any of the above named places or objects are not in a clean or sanitary condition, he shall so report, in writing, to the person charged to be re sponsible for such condition, and upon refusal of such person to put such equipment or prem ises n a olean and sanitary con dition, the Board of Health may revoke the license of the person so at fault, to practice the trade, profession or occupation in connection con-nection with which sucn places or objects were being used. Section 2. Sanitation ia Certain Places of Business. The Health Officer may inspect in-spect during business hou.i the following named places and objects ob-jects for the purpose of ascertaining ascer-taining whether the same are maintained in a clean and sanitary sani-tary condition, to-wit: (1) The offices, equipment, tools, instruments, laboratories, appliances, linen and supplies of all medical practitioners.pharma cists, dentists, barber shops, barber bar-ber schools, cosmeticians and beauty shops. (2) All pharmacies, dispensaries, dispens-aries, stores and places where drugs, medicines or poisons are compounded, dispensed or retailed. re-tailed. Section 3. HEALTH OFFICER'S OFFIC-ER'S DUTIES AND POWERS RELATING TO INSPECTION OF MEAT AND FOOD PRODUCTS. PRO-DUCTS. The Health Officer, or his duly qualified assistants, shall personally inspect all meat and food products manufactured, produced, stored, kept, sold or offered for sale within Orem City, which he may suspect or have reason to believe are im pure, unhealthy, adulterated or counterfeit. He shall enforce proper sanitary regulations in the management and suround-ings, suround-ings, produdtion, manufacture storage, keeping and sale of all meat and food products, and shall have charge, supervision and inspection of all slaughter houses, factories and places where animals are slaughtered for food, or where any article of food is prepared for human consumption con-sumption adn shall report the results of his examination and investigation monthly to the "3oard of Health, or oftener if icquired 'by sa'd Board. . For tne purpose of effectuating ihis Ordinance; the members of :he E.iJ cl II.:.l:h, city attorney, attor-ney, and their assistants shall have access, ingress, and egress to and from all places of busin ess- factories, farms, building's and cars used in the manufact ure, transportation or sale of my article of f6od as defined in this Article, -and also into restaurants, and dining halls schools where schol lunches are served, cafes, hotels and all rooms thereof, and all other places where food is prepared, stared or served to patrons. They shall have power and authority to open any package, can or vessel containing or supposed io contain any article manufactured, manufact-ured, sold or exposed for sale or held in possession with intent in-tent to sell, in violation of the provisions of this Ordinance or other ordinances of this city, and may inspect the contents thereof, and may take samples therefrom for analysis. All dealers, clerks, bookkeepers, ex press agents, railroad officials, employees or common . carriers shall render to them all the as-sitance as-sitance in their power, when so requested, in tracing, finding or discovering the presence of any particle prohibited by law, and in securing samples thereof as herein provided. It shall be unlawful for any such dealers, clerks, bookkeepers, bookkeep-ers, express agents, railroad officials, of-ficials, employees, or common carriers to fail, efuse or neglect mm to render such aid, ort to furnish furn-ish such samples for analysis, as above provided. Section 4. SAMPLE TO BE MARKED OR SEALED The person taking such sample, samp-le, as provided for in this Article, Art-icle, shall make or seal such sample, as provided for in this Article, shall make or seal such sample with a paper seal or otherwise, and shall write his name thereon, and number said sample so as to properly identify ident-ify the same, and shall tender to the manufacturer or vendor of such article or produet. or the person in whose control or possession such article or product, pro-duct, or the person In whose control or possession such article art-icle or product may be at the time the same is taken, he value val-ue thereof; but if the person from whom such sample is taken tak-en shall request him to do so, he shall at the same time and in presence of the person from whom the same is taken, seal with proper seals or otherwise two samples of the article taken, tak-en, on each of which said samples, samp-les, or in the seals placed thereon, there-on, shall be placed the name of ; person taking aid sample and also the number above provided for, the one of which sample shall be delivered to the person from whom the same is taken, and the other shall be taken by the person ! so procuring the same to the Board of Health, for delivery to a competent bacteriologist, bac-teriologist, or chemist, or other oth-er competent person appointed tor the purpose of making examinations ex-aminations or analysis of samples samp-les so taken. Section 5. ARTICLES pEEM-ED pEEM-ED ADULTERATED. For the purpose of this Ordinance Or-dinance an article shall be deemed to be adulterated; In the case of foods; 1. If any substance has been mixed or packed with it so as to reduce or lower or injuriously injurious-ly affect its quality or strength- 2- If any substance has been substituted wholly or in part for the article; 3. If any valuable constitu ent of the article has been wholly-or in part abstracted; 4. If it be mixed, colored, powered, coated or stained in a manner hereby damage or inferiority is concealed; 5. If it contains any added substance or ingredient that is poisonous or injurious to health; 6. If it contains any added an tiseptic or preservative sub stance except common table salt saltpeter, cane or beet sugar, vinegar, spices, wood smoke, or other preservatives endorsed and adopted by the United State Department of Agriculture Agricult-ure standards for wholesome food; provided, that when in the preparation of food products for shipment they are preserved preserv-ed by any external application applied in sucn manner that the preservative is necessarily removed re-moved mechanically or by maceration mac-eration in water or otherwise and the directions for the removal re-moval of said preservative shall be- printed on the covering of the package, the provisions of this ordinance shall be construed con-strued as applying only when products are ready for consumption; con-sumption; vINEST - v.fega.SKFi.v m v dW .- m our 41 year history, in wherever you see the Utoco 7. If it consists in whole or in part of a filthy, decomposed or putrid animal or vegetable substance, or any portion of any animal unfit for food, whether manufactured or not, or if it is a product of a diseased animaL ' or one that has died otherwise than by slaughter; I 8- If it be sweetened by sac-carine sac-carine or other artificial sweetening. sweet-ening. I In case of confectionery. I If it contains terra alba, bar-ytes, bar-ytes, talc, chrime yellow, para-i fine, or other mineral substance or poisonous flavor, or color, or other ingredients deleterius or detrimental to health or any vinous, malt, or spirituous li- quor or compound or narcotic drug. In the case of drugs: If its strength or nuritv falls below the professed standard or quality under which it is sold, i Section 6. PERMIT. INSPECTION IN-SPECTION FEE. i It shall be unlawful for anyi person to engage in the manu-; facture or sale of any food pro-j duct for human consumption without first obtaining a permit from the Board of Health of, Orem City, and paying for and! obtaining the license required! by the Orem City Licensing ' Ordinance. An inspection fee of one dollar shall be charged for each permit issued. Such permit shall be presented with the ap-l plication for the license to con'j auct such business, and no license lic-ense to conduct such business shall be issued unless accompan-' ied by such permit. ! SECTION 7. STANDARD OF WHOLESOME FOOD DEFIN" ED. SALE OF UNWHOLESOME , FOOD PROHIBITED. I The standards of quality, purity pur-ity and strength of food, liquors and drinks that have been or. shall hereafter he adopted by the , United States Department of Agriculture, Ag-riculture, are hereby declared to be the standards of purity and strength of food, liquors and drink in Orem City, and said standards of quality, purity and strength of food, liquors and drinks adopted by the United States Department of Agriculture Agricult-ure are hereby made a part of this ordinance, except where otherwise particularly specH fied. It shall be unlawful for any person to bring or cause to be brought within the limits of. Orem City, or offer or hold for sale, or sell, or have in possession possess-ion for sale, either at wholesale . or retail in any private or pub-; lie market, or other place in said city, any meat, fowl or fish that died by disease or accident, or any article of food intended for , human consumption, except such as is health, fresh, sound. ' wholesome and safe for human food. Section 8. UNLAWFUL FOR WORK IN BAKERY - WITH COMMUNICABLE DISEASE It shall be unlawful for any person affected with tuberculosis, tubercu-losis, syphilis,. gonorrhea, or any communicable disease to be employed em-ployed in any bakery, hotel, or restaurant or school, or place where food is handled in connection con-nection with serving the public as a cook or waiter or in any other capacity Which . requires the handling of food without mw m. we've ever made in or sign. first having been duly examin ed bv a dulv licensed physician and found to be free of tuber culosis, syphilis, gonorrhea, or any other communicable disease. Section 9. PERMITS FOR SLAUGHTER HOUSES. It shall be unlawful for any person to erect or maintain any slaughter house or yard, or to engage in the business of slau ghtering at any place within the corporate limits of Orem City, or within one mile of the corporate limits of said city, without obtaining a special per mit from the Board of Health, but no such permit shall issue or be granted unless the applicant appli-cant shall have complied with the provisions of this ordinance and rules of the Board of Health of Orem City: provided that no permit heretofore or hereafter issued shall operate to prevent the revocation of such permit or the removal or abatement of any such slaughter house or yard by the Orem City Council. No building shall be erected or con verted into, or used as a slaugh ter house in Orem City or with in one mile of the corporate lim its thereof until the plans and specifications thereof have been duly submitted to the Board of Health and approved in writing by said Board- No building oc cupied as a slaughter house or any part thereof, or any build ing on the same lot, within fifty feet of said slaughter house shall be used or occupied at any time as a dwelling or lodging place, and every such slaughter house shall at all times be suitably suit-ably lighted and kept thorough ly ventilated at all times and maintained in a sanitary con dition and shall be provided with efficient drainage, having properly trapped or other approved ap-proved sewer connections. Ceiling, Ceil-ing, walls, pillars and partitions partit-ions of all killing, meat dressing dress-ing and cooling rooms shall be kept in a sanitary condition and the walls of. such rooms must be covered to a height of six feet above the wall with some none-absorbent none-absorbent material; all floors, where any meat refuse, offal, fertilizer or any other materials derived directly or indirectly from slaughtering animals, are treated or handled must be made water-tight, -properly drained and sewer connected. ARTICLE III MEAT PRODUCTS . Section 1. OFFENSIVE ODORS FROM HANDLING MEATS All offensive odors arising from the handling of meat and treating of and caring for ofal, blood, or other material stored or manufactured must be cared for by destruction or condensation conden-sation and not allowed to escape es-cape into the outside air. Section 2. PERSONS AFFECTED AFFEC-TED WITH COMMUNICABLE 'DISEASE Persons affected with tuber culosis, syphilis, gonorrhea or any other communicable disease shall not be employed in any of the departments where carcasses are dressed, meat is handled, or meat food products are prepared; prepar-ed; and any employee of such establishment who may be suspected sus-pected of being so afected shall See Ycur utoco Dealer Superior rroweft end 'Service be reported by the Health Offlc - er to the manager of such est- ablishment and to the Board ol Health of Orem City. All butchers' Implements Imple-ments used in dressing diseased diseas-ed carcasses shall be sterilized either In boiling water or by im mersion in a prescribed disinfect ant followed by rinsing in clear water. Facilities nor sucn cleansing land disinfectant ap- proved by the Health Officer shall be provided by the estab- lisnment. Section 4. WAGONS TO BE COVERED, ETC. Vehicles in which meat or meat products are transported shall be covered and kept in a clean and sanitary condition. c : e CT1MD OP TU. SPECTOR TO BE ON MEAT SOLD IN OREM CITY It shall be unlawful for any person to sell, offer for sale, ship or bring to Orem City with intent to sell or have in his pos- ession with 'intent to sell any meat or meat food products other than that bearing the of- ficial stamp of government in- spection, or of the Board of Health of Orem City. No inspect ion shall be made of any meat of any animal heretofore men- tioned. unless the head is left on the carcass, the heart, liver, lungs and kidneys'remain in the carcass attached by their natural nat-ural cords and unless such 'or gans are fully intact. If any meat or meat food products pro-ducts of any animal, hereinbefore herein-before mentioned is found, offered of-fered or exposed for sale within with-in Orem City, which does not bear any of the meat inspection brands or marks recognized as sufficient by tne Board of health of Orem City, Utah, such meat or meat products ' shall be taken possession of by the said Health Officer or his assistants., and disposed of under his direction. dir-ection. Whfere regular slaughter houses are maintained within the corporate limits of Orem City or its immediate vicinity; the Orem City Council may appoint ap-point a competent Inspector or inspectors whose duties shall be to inspect all slaughtering and operations conducted in such slaughter houses. Section 6. FEES FOR INSPECTION IN-SPECTION The. fees to be collected for inspection services in connection connect-ion with the sale and handling of meat shall be as follows: .
