Court here amid speculation that the government seek dismissal The charges stem from a shootout in November 1975 near Ontario Ore with state police will Russ Redner Kenneth 28 Moses Loudhawk 21 and Banks’ wife KaMook 20 were arrested at that time Banks 39 was arrested in January in California A fifth defendant Anna Mae Aquash 30 was found shot to death in South Dakota in March The four are accused of illegal possession of explosives and of firearms from which the serial numbers had been filed Earlier Federal Compufers wasting millions leader trial opens AIM Robert Judge C Beloni of US Dist Court supressed as evidence seven cases of dynamite state police said they seized at the time of the arrests The dynamite was destroyed a short time after the arrests by police who said they lacked adequate safe storage facilities Sidney Lezak US attorney for Oregon is seeking a continuance while the supression order is appealed but Judge Beloni said earlier the trial would start on schedule Prosecutors have said they would rather dismiss the charges and try to reindict later than go to court without the dynamite as evidence The appeal of the supression order could take months Lezak said Belloni said no further delay is justified under the Speedy Trial Act Lezak contends a reasonable interpretation of the act does not force the government to go to trial without supressed evidence that is the subject of an appeal Banks has been charging Lezak with trying to delay the trial until after the presidential elections which Lezak angrily denies Banks has been free on bond on the federal charges and on an extradition warrant from South Dakota where he is sought for sentening on riot and assault convictions He says he fled South Dakota in fear of his life and has met with Gov Bob Straub of Oregon to ask that he not be returned there He told Straub he would like to retire from leadership of AIM and teach if he is permitted to stay in Oregon Other AIM leaders accused Banks of trying to sell out the movement Straub who has received the extradition papers says he will not decide on the matter until after Banks’ trial — WASHINGTON (AP) issue which Federal computers congressional auditors say The General Accounting Office said that in one instance the Navy took five years to fix a computer that was — on its own — initiating “at least S3 million in annual unnecessary costs” The GAO an investigatory arm of Congress made the findings in an analysis of the increasing use of computers in the federal government The study said automated computer systems are actions a year without anybody reviewing or evaluating whether they are correct” To insure more accurate computer calculations the GAO proposed closer monitoring of computers that make decisions on their own And it said that independent auditing teams should study new automated systems to make certain errors are not programmed into them In almost all cases the GAO said incorrect computer out I began to feel very responsible” Coe has spent 20 of his 36 years behind bars and spent some time in a death row cell “In some ways it hurt and in some instances it helped” Coe said about how his string of jail terms affected his career “It was hard to get credit for instruments and things like that when I got out But a lot of people identified with it as an image “When I got out on parole I went to West Virginia and played in little places — bars places like that” he said “I went to Nashville in 1968 when I got off iUJ parole” Haggard began serious performing and writing between 1958 and 1960 while serving two years and nine months in San Quentin for burglary and escape He was chosen entertainer of the year by the CMA in 1970 and his “Okie from Muskogee” is a classic GHeoDfei?
