R No 7 By Hopkins Gunther Welch and Sheffield A JOINT RESOLUTION PROPOSING PROPOSING PRO PRO- POSING TO AMEND ARI ARTICLE ARTICLE AR AR- XIII SECTION 2 OF I THE CONSTITUTION OF OT OTI I THE STATE OF UTAH REI RELATING RE- RE I I LATING LATINO T TO 0 TANGIBLE 1 PROPERTIES E EX EXEMPT X E M P T FROM TAXATION Be it resolved by bl the Legislature Legislature Legislature Legisla Legisla- ture of the State of Utah thirds two of all members elected to each earh of the two houses voting in f favor a v o 0 r thereof Section 1 It Is proposed to amend Article XIII Section 2 of the Constitution of the State of Utah to read as follows Section 2 2 All tangible properly property prop prop- erty erly in the state not exempt under the laws Jaws of the United i States or under this i tion shall be taxed in proper proper- I I tion to its value to be ascertained ascer ascer- tamed as provided by law The property of the state counties cities towns school districts municipal corporation and public libraries lots Jots with the buildings thereon used exclusively lively Ively for either cither religious wor ship or charitable purposes and places of burial not held heldor heldor or used for private or corporate corporate corpor corpor- ate benefit shall be exempt from taxation Water rights ditches c can canals a n a l Is s reservoirs power plants pumping plants transmission lines pipes and ana flumes owned and used by IndIviduals individuals in In- or corporations for tor Irrigating land within th the state owned by such individuals or corporations or the Individual members thereof shall not be separately taxed as long as they shall be owned and used exclusively for such purposes Power plants power transmission sion slon lines Unes and other property used for generating and delivering de livering electrical power a aport portion port on of which Is used for forI l L I furnishing hini power for tor pumping water for irrigation purposes on lands in the State of Utah may be exempted from taxation taxation taxation taxa taxa- tion to the extent that such is used for such pur pur- poses These exemptions s shall accrue to to the benefit of f the users of water so pumped under such regulations as the legislature may prescribe The taxes of the indigent poor may maybe maybe be remitted or abated at such times and in such manner as may be provided by law The legislature may provide for the exemption from taxation of homes homesteads and personal personal per per- property not to exceed 2000 in value for homes and homesteads and all household furnishings furniture a and n d equipment used exclusively by bythe bythe bythe the owner thereof at his place of abode in maintaining a ahome ahome ahome home for himself and family Property not to exceed in value owned by bv disabled persons who served in any warIn war warin waro in o the military service of the United States or of the State of ot Utah and by the unmarried widows and minor orphans of such persons may be exempted as the legislature may provide The legislature shall provide by law for an annual tax sufficient suf suf- sufficient with other sources of ot revenue to defray the estimated estimated estimated esti esti- mated ordinary expenses of the state for each fiscal year For the purpose of paying the state debt if any there be the legislature shall provide for levying a tax annually sufficient dent clent to pay the annual Interest interest inter Inter- est and to pay the principal of such debt within twenty years from the final passage e of of the the law law Jaw creating creating the the debt debt Section 2 2 The secretary of state is directed to submit this proposed amendment to the electors of the State of Utah at the next general election Inthe In m Inthe the manner provided by law Section 3 If adopted by the electors of this state this state this amendment shan shall take effect the first tint day of January IG 1859 1959 G.
