A legal non-conforming building, use, or parcel, commonly referred to as “the grandfather clause” or “grandfathered,” means that the use, building, or parcel was created and has been in continuous use prior to zoning laws (circa 1959) becoming effective; however, if the use or building is not used for one (1) year, it is considered to be abandoned and is no longer legal (or grandfathered). Parcels of land created prior to zoning retain a legal non-conforming use status; however, a lot or parcel of land created after zoning became effective may not be legal or, in some cases and under certain regulations and circumstances, may qualify to be brought into compliance with state law and county subdivision regulations. A legal non- conforming building can be maintained or, in the case of fire, may be restored to the same size, location, and use within one year in order to retain the legal non-conforming use status; however, it may not be moved to another location on the lot or parcel unless approved by the Weber County Board of Adjustment.
