JUDGE NOYES WILL BE REMOVED FROM OFFICE General Attorney Delivers His Findings Findings Findings Find Find- ings in Alaskan Jurors' Jurors C Case WASHINGTON WASHINGTON Feb 24 Attorney Attorney- General Knox delivered to the President President President dent his findings in the matter of the charges filed against Arthur E Noyes Judge of the Second division of the United States District cour court of Alaska The charges allege Incompetency and corruption although the Attorney- Attorney General says the charge of dishonesty was was not pressed After fter reviewing the charge at length the Gen Attorney eral eras concludes his report as follows First That First That the appointment of a re receiver receiver re- re celver in the case referred to without notice to the defendants and the refusal i upon hearing to discharge the receiver receiver and the consequent dispossession of the defendants of their property were not justified under the th facts the pleadings and the principles of equity Second That Second That there Is no justification shown for the refusal by Judge Noyes to o settle a bill of exceptions at the In Instance Instance instance stance of the defendant and for the refusal refusal refusal re re- re- re to allow them an appeal Third Third That That after an appeal had been allowed w b by the ire Circuit Court of Appeals l ee and the writ of supersedeas r had had been served upon Judge Noyes the plaintiffs and the receiver Judge Noyes' Noyes attitude I toward oward the writ was one of hostility and obstruction which was totally inconsistent ent with his judicial duty towards a superior court and nd toward the litigants seeking through that court reversal of his judicial action Fourth That Fourth That Judge Noyes should forthwith be removed from office The President will approve of these findings and promptly dismiss Judge Noyes from froIn office e. e
