Show heywood AT the task of selecting jury in III the fint of the famous cases now under way family of the accused man in the court room at the opening ses sion wh ch eh was unmarked by unusual incident boise idaho thursday may 9 the opening day of the trial of wil ham liam D haywood Efey wood the first to be placed on trial of the alleged participants in the avenging conc conspiracy piracy by which it Is averred the assassination of ax governor frank was plot ted and executed was unmarked by y unusual incident it was earnest and business like its striking feature was the entire absence of crowds or dem in any form at no time morning or afternoon was the court room more than half filled and the streets forming the courthouse square contained not a single loiterer the case was halted shortly before 5 0 clock an adjournment be ing taken until monday and no juror was secured but substantial pro gress was made mr haywood was brought into the court room sharp at 10 0 clock in the morning he found his family in a line of chairs to the right of his seat and in front were all of bis his counsel he devoted more attention to his youngest daughter than to any one else and throughout the day took no part in the selection of jurors furors many men in similar jeopardy as a rule make close study of their prospective jurors and frequently ex press their personal preferences but mr haywood seems content to leave the matter entirely in the hands of his lawyers haywood gave no sign of any feeling or emotion but sat quiet ly throughout the day mrs haywood and the older daughter stood the ordeal of appearance in court very well but the younger child cried after the examination of tales nen began mrs haywood and her children did not at tend the afternoon session the question of the defense took la much wider range than that of the state and its most striking feature dealt with the possible effect upon the minds and attitudes of jurors of the letter of president roosevelt Koo sevelt in call ing haywood and his associates ua un dersi rable citizens the speeches in idaho of secretary taft the message of governor gooding to the legiel legislature of idaho the speech in boise of sena tor heyburn and the action of the idaho legislature in passing a reola tion and appropriating money for the prosecution of the three prisoners the chief concern of the counsel for the state in the examination of tales men as indicated by their questions was their attitude toward circum stan 1 evidence the absence of the ac aused from the state when the crime was wa committed the eff effect act of the man ner in which the prisoner and his corn com paulins were brought from colorado views of the tal esmen as to the death penalty for murder in the first degree and union labor they also questioned each as to his acquaintance with the murdered governor with a view to disclosing disc lobing friend or en ell mity judge wood announced that he in tended to give both sides a wide lati tude in the examination of tal esmen he also showed a willingness to grant challenges where there seemed any reasonable objection to the attitude of the and in the one contest of the day he ruled with the defense which had challenged the and was resisted by the state lawers lawyers of boise not connected in any way with the cae but who know as much as is known of what both sides expect to do say ay that after the jury is secured the trial of the ca caa ought to be over in wo weeks judge fremont wood eliv ear acts to waste no time and another adjournment is not looked tor for the court will sit from 10 a in to noon and from 2 to 5 p in and sometimes until 6 0 clock with one long session on saturdays several members of the western federation of miners who are now in boise watching the progress of tha the cae cace do not join in the belief exist ent in some quarters that orchard arill infuse to testify they believe that he will make his statement upon the stand on all sides there Is a question as to how far orchard will be allowed to go in his statement which it is alleged implicates hay wood moyer and pettibone it Is around this evidence that the whole case undoubtedly will move |
