Deserct JSews has Dear Sir, As several persons have recently made similar inquiries of me, I have thought it proper to sub mit the following for publication in the News. Apart from these considerations, however, his course is utterly wrong anU inde fensible, fer even supposing that he had been empo-vereto declare Can non ineligible, that authority could not have justified him in issuing the certificate to Campbell. There are few points in American political law more thoroughly settled then this. Our courts have repeatedly and alt most uniformly held that th inel igibility of a majority candidate does not elect the minorii v candi date. There is moreover one eele brated eise in point which we should have a supposed Republican Governor could not have forgotten. We reterto thatot Crontn.the Ore gon Elector. The Electoral Commission adjudicated that case, and in line with the position hero stated, the Republican counsel had taken this ground, and their view was accepted by the Commission. In this State there hare been several deci sions by the Supreme Court to the same ettect, and in fact it may be said that American law has taken this stand as a finality. The justice of the position is, we consider, undeniable. In every political contest it must be held that 'he majority not only vote fur the candidate who receives their BuftiRge, but aiaiiist the candidate who is defeated. Should the umjority condidate. therefore, be shown to have been ineligible, it is impossible that the condidate should be minority entitled to the oflice, since it is clear that he was rejected by the majoris ty. In such a case the only tenable conclusion is that there has been a failure to elect, and it becomes necessary (supposing the course possible, as it may not always be) to hold a now election. Governor Murray consequently has committed a twofold error. He has usurped the prerogative of Congress in undertaking to pass upon the qualifications of an elected delegate to that body; and ho has issued his certificate in contravention of the established law ia the premises. A more flagrant cae ot lawlessness in an executive otu cer has in fact seldom occurred For high handed usurpation and defiance of the ruling of the Courts. it is only paralleled by the action of Governor Garcelon, ot Maine, and it is rendered peculiarly aggravating by the fact that Governor Murray is a Kepublican, and has, notwithstand ing, gone counter to what may be regarded as specially Republican doctrine. He had no right to re fuse a certificate to Cannon. The law allowed him no discretion in the mutter. It directed him to issue his certificate to the candidate who had received the largest number of votes, and it did not empower him to in stitute researches of his own motion into the eligibility of that candidate. Early this morning, some excitement was caused in this city from a report that H. Parry, son of Mr. Jos. Parry, had taken poison, and uo hopes were entertained ot his recovery. As far as we have learned the circumstances of the case are as follows: Last evening young Parry, in company with Al. Harris, son ef Jos. Harris, attended the performance at Union Opera House. At the conclusion of the piece, Parry invited Harris to accompany him home tht to sleep. Harris accepted, and about 12 o'clock tbe two parties reached Mr, Parry's residence, on Main St., and proceeded to Hyrum's mom. While the latter went out to the pump, to procure a drink of water, his usual custom before retiring, Harris went to bed. Parry returned to the room, and proceeded to drink something from a small vial. Harris asked him what be was drinking, and the reply hot being saiisf.cioiy the former became alarmed, and sprmg' that his ing from the Led. companion had taken a large quan tity of laudanum. Harris gave the alarm, and the father, with other members of the family were aroused. Drs. Carnahan and Powers were sent for, and were soon on the spot. As no stomach pump could be procured, strong emetics were administered. Both medical gentlemen were most assiduous in their attentions during the rest of the morning and although it seemed for several hours that the case might terminate fatal'y, we were informed,at 2 o'clock this p. m., by one of the medical gentlemen in attendanee,that strong hopes were entertained of the young man s recovery. Up to this time we have not learned that Hyrum had given any reason for his i ash act, and it will perhaps be a day or two before he is sufficiently recovered from the af lects ot tlie narcotic to give any lucid explanation of the cause that led him to take the poisonous drug When last seen by our reporter, the unfortunate young man was resting well, his pulse being more regular than at any time since taking the opiate. ,, . Ever since the slide took place, on Friday night last, men have maintained as steady work as possible to recover these bodies, and on Monday night they they came across that of Lees; but let it remain all night, fearing to work further that night lest they should chop it and the others with their spades. Early on Tuesday morning, work was renewed and the bodies of all three were taken out of the ruins in the cellar. It is now ascertained that they were neither burned nor suffocated to death, as had been the general opinion ever since the terrihls occurrenee. The bodies of the three were found in their beds, probably undisturbed, but they bad been very badly crushed and bruised, and death had ensued from theso bruises.
