Show MINER'S CASE IN COURT. Judge Kirkpatrick Pleads for An. relius, and the Disbarrlngis Further Considered. The disbarment matter of Aurelius Miner, set for this morning, was taken up shortly before noon, and Mr. Kirkpatrick, in behalf of Miner, addressed the Court. He said the considerations to be taken into account before the disbarment did not embrace moral turpitude as taken in its broadest sense as used in the statute, and cited several opinions. In a clear case of misconduct which seriously affects the standing of the person "as an attorney, the matter of disbarment is considered. It is for a disregard of an attorney's duties in his professional career that his trustworthiness to act in the capacity of a lawyer is questioned, and by the Court he may be summarily disbarred. dis-barred. It is the opinion of several eminent em-inent judges that no attorney . can be disbarred for sexual immoralities which are outside of moral turpitude tur-pitude as understood by the .courts. Whoever heard of an attorney being disbarred dis-barred for sexual irregularities? No lawyer law-yer has ever been disbarred for any such charge,, which is entirely outside the case at hand, and it docs not come within the domain of such moral turpitude. After Mr. Kirkpatrick closed his address ad-dress the Court took the matter under further advisement, and Aurelius was returned re-turned to the Palace on the Bench. |
