Show EXPERT TESTIMONY. ' Three of the leading physicians of the town were before the Court yesterday to testify as to the physical condition of defendant de-fendant Hampton. Two of these physicians physi-cians said that to incarcerate Hampton would be to endanger his health, while one said it would not. It is impossible for the non-professional to say which view was right, for when doctors disagree where shall we look for truth? But this case yesterday very well illustrates the worth of expert testimony. It is worth no more than the testimony testi-mony of those who are not experts. In many of the mining cases which have been tried in this Territory, mining experts of reputation have been put upon the witness stand by each party to the contest and the experts have been more partisan than the clients and their attorneys. . The testimony of one expert being as good as another and the one refuting re-futing the testimony of the other, wherein is the superiority of expert testimony over the evidence of every day people ? The testimony of one expert but counteracts counter-acts tire testimony of the other. Expert testimony may be very well described by saying that it is a scientific "first .come first served." |
