Show ON FOUR COUNTS A Verdict Against Jensen in Eight Minutes Duucau and Homer Plead Guilty The first case taken up at the afternoon session of the Third District Court was that against Homer Duncan charged in a onecount indictment with cohabiting with Azenith Duncan and Sarah Tripp The defendant pleaded guilty and took the statutory two days for sentence Hyrum P Folsom was then arraigned on a like indictment charging unlawful cohabitation with Nancie B Folsom and Annie Lenzi lie also pleaded guilty and asked the Court to suspend sentence for as long a time as possible Defendant was allowed until Saturday morning at 10 oclock Carl Jensen was then called He had already pleaded not guilty to a fivecount indictment and the jury was therefore called The following jurors were all passed without challenge George Morrison James WinchesterS Winchester-S 0 Underhill George Mullett Louis Bamberger Alfred Thompson S C Pancake B P Martin J B Wilson Joseph Foster Albert Fisher E M Bynon The jurors were then sworn and the examination of witnesses was beun Anna Jacobsen was the first witness sworn It was found that the lady did not speak English and Magnus Olsen was therefore sworn as interpreter Witness said I live at West Jordan have lived there seven years I was married mar-ried to Carl Jensen in 1881 in this city have lived in the same house ever since know Betsy Jensen have known her since 1881 j have heard defendant speak of Betsy as his wife heard this before the Marriage Betsy has lived about six miles from me for three years before that we both lived in the same house last went to Betsys about one year ago went alone remained there about two hours went home alone have been at Betsys house when defendant was present pres-ent not many times last saw defendant there about a year ago defendant took meals at same table with them this was about three years ago have gone to Bet sys with defendant went with him most of the time defendant has lived continually contin-ually with me during the last three years have two children the youngest is one year old Betsy has two children the youngest is about 12 years old To the defense Last saw defendant at Betsys house about one year ago he was there just like a person waiting he never lived thereTo there-To prosecution Defendant still speaks of Betsy as his wife To defense Dont know anything he has said to that effect I am the only one defendant has recognized as his wife To Mr Dickson He did not recognize recog-nize Betsy as his wife when we went to her house Betsy comes to my house sometimes she never stopped all night Excused Magnus Olsen was then put upon the stand I married Jensens daughter Betsy lives upon a portion of my ranche we visit Betsy every day have seen de fendant at Betsys house quite often saw him there five or six times a year have seen him there since the first of January about twice about a year ago he worked a piece of land there and he came over to Betsys house quite often never met him in the house To defense Defendant usually goes there to take her something I know I that it was agreed for him to take another I wife and let the first one retire Mr Dickson announced that he dismissed dis-missed the last count of the indictment and then rested Mr Rawlins stated that he did not think the charge could be sustained upon more than one count because there was simply a presumption of cohabitation I and as this was evidently one continuous offense it could not be segregated Mr Dickson said there was evidence to show that the defendant had met this other woman as his wife while he was living with Anna and according to the law he could therefore be convicted The case was then submitted without argument and the Judge made a brief charge to the jury After being out about seven minutes I the jury returned a verdict of guilty on aU four counts One week from tomorrow was set as the date for sentence |
