Show A SHORT TRIAL Testimony in the Simpson Case Closed and Arguments Commenced The twelfth juror was secured in the Simpson polygamy case yesterday afternoon after-noon at 4 oclock The jury as completed com-pleted was as follows James E Paine G D Schell John McLains Edward Bird I A Brim J 11 Nichols Edward Roche G W Walton W H Knox J W Mecham Isaac Jennings Adolph Anderson The evidence for the prosecution in this trial is the same in substance as submitted in the examination before Commissioner Com-missioner McKay a few months ago which was published in all the city papers at the time and a rehash of the testimony is therefore unnecessary now i Simpson is charged with marrying Emma Everett in July 1SS3 having at that time a wife living and uudivorced towit Hannah Powell Simpson Eleven witnesses wit-nesses were examined by the prosecution prosecu-tion An attempt has been made to invest this case with extra interest by alleging that the defendant was not a Mormon It has been learned that he was a Mormon at the time of the alleged second marriage but has since been excommunicated excommu-nicated The marriage to Mibs Everett however was not what is known as a celestial marriage it having been performed per-formed by Judge Smith and a marriage certificate issued The prosecution rested their case this forenoon and several witnesses were called for the defense Among them was Mm Powell the alleged first wife who denied that she was now or ever had been the wife of the defendant Simpson was also placed on the stand and denied the alleged first marriage The evidence was all submitted and Mr Diokson made the opening argument when court was adjourned until this afternoon after-noon |
