Show Dismissed ST LOUIS May 5Tho trial of Express Messenger David S Fotheringham was resumed re-sumed in tho Criminal Court yesterday Conductor Spangle was recalled and testified testi-fied that the messenger was tied to sta and when he was released his limbs were numb Ho said Fotheringham told him that he heard a knocking at the door when the train stopped at Minokc but did not respond because be-cause at that time the robber covered him with a revolver The defense brought out the fact that tho messenger was compelled to receive passengers passen-gers in the express car on the orders of a superior Tho conductors testimony showed that the robbery was not committed in this city and the defense moved that the case be thrown out of court Judge Narmile cave a his opinion that the robbery did not occur in this city and consequently it was out of the Jurisdiction of his court and accordingly dismissed the case county I will now be carried to St Louis |
