the colorado state line case no report and 1 tentative order contract carrier permit no this matter coming up for consideration by the public service commission of utah upon the formal application of juan benito sanchez requesting the issuance of a permit authorizing him to operate as a motor contract carrier for hire of uran lum aum ium copper bearing ores upon and along public highways over irregular routes from points and places in utah within miles of monticello utah t to 0 monticello blanding moab thompson and green river utah and to tag th colorado state line where U S highway N no 0 intersects such state line under written contract with the white canyon mining company of cortez colorado original of which contract is filed with the application and it appearing that this application is not likely to meet ath opposition or be contested and therefore may be handled under the rules of the commission covering summary procedure and the commission being fully advised in the premises now makes and enters the following findings of fact and conclusions FINDINGS OF FACT al 11 1 that applicant is an individual id u doing business under the firm name and style of J B sanchez of dove creek colorado 2 that applicant has filed a financial statement showing he is financially able to perform the contract carrier carrier opera operations eions proposed in his application and nas tendered all insurance required by law 3 that applicant has also filed a schedule lg of his equipment which appears to be proper in all particulars in compliance with the laws of the state of utah and the rules and regulations of this commission 4 that the highways over which applicant proposes to operate as a contract motor carrier are not unduly burdened and the granting of applicants application and the operation of applicants equipment pursuant to contract agreement f filed I 1 I 1 e d herein will not unduly burden the public highways nor be detrimental to the best interests of the people of the ahe state of utah t that hat existing transportation facilities do not provide adequate or reasonable service 5 that applicant is a nonresident of the state of utah and therefore should be required to appoint and designate in writing some person a resident of the state of utah as his agent upon whom processes notices and orders of this commission as well as the courts of utah may be legally served within the state of utah 6 that the contract filed herein by the applicant and white canyon mining company of cortez colorado is proper as to form and the rate and charge named therein is found to be just and reasonable from the foregoing findings of fact the commission now makes and enters the following conclusion the applicant should be forthwith granted a permit to operate as a motor contract carrier tor for hire of uranium copper bearing ore upon ands and along public highways over irregular routes from points and places in utah within a mile radius ot of monticello utah to monticello blanding moab thompson and green river biver utah ana the colorado state line where U S highway no intersects such state line in keeping with the foregoing findings of fact ORDER OBDER IT IS THEREFORE ORDERED that applicant juan benito sanchez be and he is hereby issued contract carrier permit no authorizing him to operate as a motor contract carrier tor for hire of uranium copper bearing ore upon and along public highways over ever irregular routes from points and places in utah within a mile radius of monticello utah to monticello blanding moab thompson and green river kiver utah and the colorado state line where U S highway no intersects such state line pursuant to written contract filed herein between J B sanchez of dove creek colorado and the white canyon mining company of cortez colorado IT IS FURTHER ORDERED that applicant shall file and maintain on tile file with the commission all necessary insurance as required by law and shall operate at all times in accordance with the laws and statutes of the state of utah applicable to motor contract carriers as well as in compliance with all the rules and regulations of the public service commission of 01 utah and that any failure on the part of the applicant his agents or servants to operate in compliance with these statutes rules or regulations shall constitute grounds for either the suspension or revocation of the authority herein granted IT IS FURTHER ORDERED that applicant shall forthwith appoint and designate in writing some person a Tes resident ident of the state of utah as agent for the applicant within the state of 0 utah upon whom processes notices and orders of this comm commission or ot of the courts of utah may be legally served that executed copy of such
