out in C the following ordinance and for the purpose of submitting to the qualified voters of said town the question set out in ain ordinance adopted by the town board on oil may alay 11 1919 lia which ordinance is as follows NOTICE of SPECIAL ELECTION ORDINANCE NUMBER 2 1949 AN ORDINANCE providing for the holding of a special election in the town of monticello utah for the purpose of submitting to the qualified elec clec tors thereof the question of adopting an initiative ordinance providing for the construction of a sewer system and extensions and improvements to the municipally owned electric tern tem and water plant and system of odthe the said town and auth authorize oriz ing the issuance of electric water and sewer revenue bonds for the purpose of defraying the cost of the construction st of such improvements and extensions WHEREAS there has this day been presented to the town board an initiative petition requesting that the board either adopt the ordinance therein set out or submit such ordinance to the vote of the qualified electors of the town of monticello for adoption said ordinance being entitled ORDINANCE NUMBER 1 1949 AN ORDINANCE providing for the construction of extensions and improvements to the municipally owned utility of the i town of monticello consisting of an electric system and water plant and system and sewer collection and disposal system authorizing and providing for the issuance of electric water and sewer revenue bonds of said town for the purpose of defraying the cost of the sitio n of such extensions and improvements prescribing the form and other details of said laid bonds confirming the sale thereof providing for the collection and disposition of the revenues of said utility making other provisions with respect to the operation of sala said utility and the issuance of said bonds providing for the payment of said bonds and ratifying and ap proving the contract heretofore entered into for the cons construction t ruction of such extensions and improvements and WHEREAS it has befit ascertained by the town board that at the last preceding election for governor held in the town of monticello there were cast for all candidates a total of votes and it has been determined by the town board that the initiative petition for the above entitled ordinance di a arice is is sigi signed led by legal ag voiers rs qualified to sign said petition till tion and that said petition contains the number of qualified signers required by chapter 10 of title 25 of the utah code annotated 1943 and WHEREAS said initiative petition t has been in all other respects ts carefully examined and has been found by the town board to be full and complete and to com comply adly in an all respects with the requirements of said chapter 10 and WHEREAS the ordinance set out in said petition nas bas been adopted by the town board subject to aD approval of th qualified electors af pf of the town of monticello utah and it is board of the town of Al monticello san juan county utah as follows section 1 that there shall be held in said town on the day of june 1949 between the hours of seven am and eight PM a election at which there shall be submitted to the ibe legal voters of the said town the question of the approval of I 1 the ordinance described in the preamble hereto section 2 that all electors of the town of monticello qualified ithe to vote on said proposition under the provisions of 0 the constitution of utah and title 25 of the utah code annotated 1943 shall be permitted to vote at said election section 3 there is within monticello ti utah one precinct for election purposes and registration and that the voting place for said precinct and the election officials thereof to serve at the election registration agent for his election district shall between the hours of eight AM and nine PM on oil the first and third tuesdays immediately preceding said election receive and register the names of all persons applying for I 1 re registration who are legally qualified and entitled to vote at such election or who will legally have acquired a residence being otherwise qualified and who will have a right to vote at said election according to the provisions of the law under which said election is to be held and said registration agent shall give the notice of registration required by the general e I election laws including sec tion tio n 2 2 2 10 of the utah code annotated 1943 section 5 that each registration agent shall post in at least five 5 conspicuous places within the district at least find and to distribute said pamphlet t to I 1 every voter of the town of monticello either by mail or carrier not less than eight 8 days prior to tile the date herein fixed for the election at which said proposition is to be voted upon section 9 that immediately after its adoption this ordinance shall hall be signed by the town president and town clerk shall be recorded in a book kept for that board of the town of monticello utah be authorized to issue the bonds of the town in the amount of 85 for the purpose of defraying the tha cost of constructing a sewer system of improving and extending the municipally owned water and electric systems all to be operated as a single utility said bonds to bear interest at 6 pet per annum until june 1 1955 and avi thereafter and to ma ture serially on june 1 of each of the years 1951 to 1974 inclusive 1 and to be paid solely sol elyas as to both principal and interest from the revenues to be derived from the operation of said electric and water and sewer systems and under no circumstances to be a general obligation of the town or payable from ad valorem valoree taxes all as provided in the J initiative ordinance adopted by said
