board on oil way may 11 1949 which ordinance is as follows NOTICE of SPECIAL ELECTION ORDINANCE NUMBER 2 1949 AN ORDINANCE providing for the holding of a special election in the town of monti cello utah for the purpose of submitting to the qualified electors thereof the question of adopting an initiative ordinance providing for the construction of a sewer system and extensions and improvements to the municipally owned electric system and water plant and system of the said town and authorizing the issuance of electric water and sewer revenue bonds for the purpose of defraying the cost of the construction st of such improvements and extensions 0 WHEREAS there has this day been presented to the town board an initiative petition requesting that the board either adopt the ordinance therein set out or submit such ordinance to the vote of the qualified electors of the town of f monticello for adoption said ordinance being entitled ORDINANCE NUMBER AN ORDINANCE providing for the construction of extensions and improvements to the municipally owned utility of the town of monticello consisting of an electric system and water plant ant and system and sewer collection faction and disposal system authorizing and providing for the issuance of electric water and sewer revenue bonds of said town for the purpose of defraying the cost of the siaion of such extensions and improvements prescribing the form and other details of said bonds confirming the sale thereof providing for the collection and disposition of the revenues rev e of said utility making other provisions with respect to the operation of said utility and the issuance of said bonds providing for the payment of said bonds and ratifying and approving the contract heretofore entered into for the construction of such extensions and improvements WHEREAS it has been ascertained by the town board that at the last preceding election for governor held in the town of monticello JH there we were re c estimated that the cost of said I 1 improvements movements rove ments and extensions and t the ducost cost of the construction of said sewer bewer system will be of f which ch is to be financed through t the issuance of general obligation t bonds and through the th e making of sewer connection charges and it is desired to provide ifor for the payment of the remainder thereof through the issuance of revenue bonds to the amount of and WHEREAS except for water revenue bonds of the town dated september 1 1936 numbered 23 to 43 inclusive bearing interest at six per cent per annum authorized zed by ordinance number adopted july 27 1936 and payable solely from the revenues df the waterworks water works system of the own the revenues to be derived y the town from the operation of its water plant and system and its electric system have not been the town attorney and approved by the town board section 8 that the to town clerk is instructed and directed to prepare the publicity pamphlet required by sections 18 and 23 of chapter 10 title 25 utah code annotated 1943 to incorporate petition for the above entitled ordinance is signed by legal voters qualified to sign said petition and that said petition contains the number of qualified signers required by chapter 10 of title 25 of the utah code annotated 1943 and I 1 WHEREAS said initiative petition has been in all other respects i carefully examined and has been found by the town board to be full and complete and to comply in all respects with the requirements of said chapter 10 andi and WHEREAS the ordinance set out in said petition has been betl adopted by the town board subject to approval of the qualified electors of the town of monticello Montice IIo utah and it is desired to call a special election at which the question of the adoption of said ordinance may be referred to the electors qualified to vote thereon now therefore be it and it is hereby ordained by the town board of the town of INI Montice IIo san juan county utah as follows section 1 that there shall be held in said town on the day of june 1949 between the hours of seven am and eight PM a special election at which there shall be submitted to the legal voters of the said town the question of the approval of the ordinance described in the preamble hereto section 2 that all electors of the town of monticello Montice IIo qualified to vote on said proposition under the provisions of the constitution of utah and title 25 of the utah code annotated 1943 shall be permitted to vote at said election section 3 there is within monticello ti tice IIo utah one precinct for election purposes and registration and that the voting place for said precinct and the election officials thereof to serve at the election shall be as follows voting place court house election officials elizabeth halls elva jones el nora christensen alternates isabelle redd lena christensen ruby bronson section 4 that the registration agent for his election district shall between the hours of eight 0 clock AM and nine PM on the first and third thesda tuesdays immediately preceding said election receive and register the names of ate ira shall in the holders of such bonds section 2 that from and after the adoption of this ordinance the water system and the electric and sewer system shall so far as practicable be operated as a single unit and with a single maintenance and clerical force provided however that the tha books and records of the systems shall be so kept and maintained as to comply with the provisions of ordinance number aforesaid and as to make it possible to ascertain separately the gross and net revenues derived from the operation of the water system the electric and sewer system in making such separate computation of revenues all expenses incurred as a joint expense in the operation of the systems shall be apportioned to the systems on oil such reasonable and equitable basis as may be prescribed by the managing officer of the systems and approved by the board of trustees quai duj ita wilo will vill have a right to vote at said election according to the provisions of the law under which said election is to be held and said registration agent shall give the notice of registration required by the general election laws including section 25 2 10 of the utah code annotated 1943 section 5 that each registration agent shall post in at least five 5 conspicuous places with within in the district at least five 5 days prior to the date fixed for said election the following election notice which notice shall also
