| Show LIQUOR ADS ABS IN UTAH ILLEGAL SAYS ATTORNEY the following letters published in ill the voice of sharon a utah paper will be read with interest by many the record had already refused to publish liquor ads before the attorney general gave his opinion on the I 1 I 1 matter 1 april 22 19 OG honorable joseph chez attorney attorn ey general state capitol salt lake city utah dear mr chez I 1 have recently that teat liquor ads are being carried in so some me of the newspapers published in utah As one who assisted in drafting the liquor law as it was presented to the governor I 1 have been very much interested in the prohibition of any form of advertising liquor or otherwise wise promoting its sale I 1 am writing to ask for your interpretation of the liquor law as it applies to advertising or other means of pro pr motin sales of liquor very truly yours signed MILTON BENNION dr milton bennion university of utah city dear dr bennion in response to your courteous courted ja letter lette r of recent date in which you ask for an interpretation of our state liquor law as it applies to liquor ad erti please be advised that sections and of chapter 43 laws of utah 1935 cA expressly pressly prohibit hibit advertising of alcoholic beverages in in newspapers published and circulate within the state the utah law of course does not and cannot cannat override the laws of the united states which permit newspapers carrying liquor advertisements to enter utah under the interstate commerce provision of the united states constitution trusting this will give you the information you seek I 1 am very truly yours signed JOSEPH CHEZ attorney general there are many who have believed a long time that the newspapers in utah chich published hard liquor advertising ver hsing were violating the laws law of the state and making money out of an unlawful business and should receive attention of the liquor com mission the sections mentioned by mr bir chez in his letter prohibit the liquor commission and any manufacturer of alcoholic beverages from in the state of utah the stated state law also makes it crime for anyone to ass assist assists istl aid or abet in any way another in the comm commission assion of the crime crie while the he law does not expressly say that a newspaper cannot carry liquor advertising it does say that a manufacturer may not advertise if the manu factum er does advertise and the newspaper publishes its advertising in its c columns 01 urn ns and thus aids and assists and abets him in violation vio lotion rf of the law it it equally guilty under the law provided of course that the attorney general is right in his oj the utah law as pointed cut ut by mr air chez affects only papers act actually lually printed and published in the state of utah and cannot apply to papers arid and advertising printed outside of utah which have the under the unit auit ed states constitution to come in the state and be distributed hwe here this class is very limited and enters coar ively few homes the state can ca only control what is done within its borders it is understood that the attorney general is advising the county attorneys of the state that they should prosecute any violation of the law prohibiting the advertising of alcoholic beverages of course it is not necessary for the enforcement aft officers of the various counties to wait for hs this advice from the attorney general as the law laai is as well known to them hem as it is to him it seems now that as far as utah county is concerned the matter is up to the sheriff and the county attorney there are certainly numerous violations in this county well known to everybody every bady what these officers will do about it remains for thern them to determine the voice of sharon |
