Show vernal firm files suit to recover taxes charging that the company was wrongfully taxed by james H anderson collector of internal revenue revenue li 11 II woodward company of vernal seeks to recover from the collector in a suit filed monday in the united states district court the company does business as the woodward curry furniture company 1 the complaint alleges ithac an audit conducted by the internal revenue bureau after the company had filed its returns for 1917 was not a true arid and accurate inventory of the stock held by the furniture company and further that mr anderson waited after the stater tory period for levying an additional assessment according to the complaint the amount named is an assessment in addition tp returned and paid by the plaintiff company for income taxes in tile the year 1917 the complaint further recites that after mr air anderson had fiade the additional dit ional assessment an offer for ia a compromise consisting of was paid to the collector this amount was taken by mr anderson upon threat of distraint of P property ro perty the company paid the bit balance lance of fixed by mr anderson the complaint reads the company first filed and paid its income tax return march 8 1918 on march 17 1923 an additional dit ional assessment of plus 5 5 per cent as ag a penalty was made the company filed claim L for abatement but was refused by the 61 collector lector the offer tor for a compromise ii was made made july 1924 the alleges in october 1926 after mr air anderson threatened distraint ot of the prop property erak the full amount was paid an amended return with a claim of was filed by the company lit in december and it is upon this return that the suit is based |
