Show utah s anti cigar et measure Is very drastic the southwick lck bill as it passed the house ot of representatives and as lb ib was previously passed by the senate is as follows senate bill no 12 by y mr southwick an act making it unlawful to sell zi i garets and ana papers to adver I 1 tise lise ci garets and papers to permit minors io to smoke in certain places of 0 busi business hess tor for any person to smoke in certain enclosed public places be it enacted by the legislature ol of the state 61 utah section 1 it shall be a misdemeanor for any person company or corporation orp oration to barter sell keep lor for sale furnish or give away any eig abets or olgaree papers paper f or any disguise or substitute of either of these a or r t to 0 have any cf alecta papers in or about any store or other place tor for barter sale or fredi it if upon what seems to ie e reasonable e evidence any person kompany or corporation is suspect d ot of having in his or its possession ny cl el garets or cigar et papers in ended to be offered tor for barter sale ir r free distribution then upon the worn complaint ot of any citizen of the state of utah specifying lully fully as to he alleged facts of 0 the case any ot of authorized to make arrests may pon the issuance of 0 a search or search warrants in the maner mailer and form prescribed in chapter 6 title ot of the code of criminal rocc lure dure sees 9 search lie he premises of such person corn com any or corporation and may seize ny ety ci el garets or papers so annd all such ci garets or apers so seized under the provisions f tills this act shall be e ordered destroyed y the judge of 0 the court in which nal conviction is had the w poss I 1 lon ion of such material shau shall be e onside considered red prima facie evl evidence en ce or IZ a erect violation ot of this act section 2 it bo be a neanor for any ally person company or corporation orp oration to write print publish m r circulate in any newspaper maga ine periodical or circular writt mitten cli hinted or published within the state of at utah any advertisement of elgar ets or papers or any disguise or subterfuge of either of these it shall also be unlawful for or day any person company or corporation to post poat exhibit or publish on any street sign placard or billboard or in or on an any package of merchandise store window showcase or any other place within the state of oc utah any advertisement ti for ci garets or papers pr or any di disguise or subterfuge of either of these section 3 it shall be a misdemeanor for the proprietor ot of any place of business to knowingly permit minors under 21 years ot of age to frequent such places of business while in the act of using tobacco in ill any form the term place of business as here used shall apply warty and all such places as shops stores factories public garages offices theaters recreation and dance halls pool rooms cates cafes cafeterias cabarets restaurants restaurants hotels lodging houses street cars interurban and railway passenger coaches arid and waiting rooms section 4 it shall be a misdemeanor for any person to amolie cigars ci garets or tobacco in any enclosed public place within the state slate of utah except in extra extra rooms compartments or coaches specially I 1 provided tor for smoking ting purposes the term enclosed public place as here used shall be construed to mean the dining rooms in hotels restaurants cafes and cafeterias theaters passenger elevators street cars interurban and railway passenger coaches motor and other passenger vehicles employed as common carriers railway station waiting rooms barber shops state state county and city buildings section 5 it if any section sect se stion ioa subsection clause phrase or word of this accas act is foran y reason held to be unconstitutional suc such it lie decision cislon hall i not affect the validity of the remaining portions of this act I 1 section 6 this act shall take effect fact and be in force ninety days from the date of its passage |
