Show TEMPORARY RELIEF judge tillman D johnson of the united states district court decided in salt lake wednesday wat the government must pro the water available in the Lake fork and other streams to the government acting for indian lands and the defendants the settlers commencing ten days from the date of the order ippich was july 26 A F federal court coat commissioner will be appointed to this important duty and commencing about august 7 the water will be prorated pro rated according to the amount of water w ater that each individual actually needs need the indians will also be alioti allotted d only what they actually need and the remainder of the water will not lot be permitted to run to waste the trial will n not t come up before next march or april the outline of the defense as made by one of the attorneys is as follows the state law states that the water to be held must be put to beneficial use this question did not enter into the order of judge johnson johnsoa John sor but will be one of the main points in the coming trial the defense assert that they can prove the government has not done this of course if this is proved it is probable that the government filings which the defense admit are prior would be revoked and the settlers would obtain the water the defense is also going to test the legality of the fact that the government has held these filings by virtue of extensions of time etc tc for fourteen years this the defense believes cannot be done legally affidavits were presented by the defense wednesday to prove that there was enough water flowing la in the Lake foik and other streams rt nt r t present to irrigate all the lands now under cultivation ti the decision of judge johnson johnn johns on means that the defendants will obtain water all this summer to crops A very bitter legal battle battla will be waged before next summer however c to occide this question |
