Show MIGRATORY AGRA WRY BIRD LAW A misleading statement has i recently become current in news papers of the mississippi valley and pid elsewhere to the effect that the department of agriculture has suspended the enforcement i af pf of the federal regulations under I 1 the migratory B bird I 1 ard law and by this means has enabled ports imports 1 i men under state laws to shoot wild wi id foal 1 I the coming spring under the federal regulations as they now stand the season j on all migratory wild fowl is closed until next autumn through put out the united states federal inspectors and wardens are required and others antei interested sted in the protection of wild fowl are requested to report to the de 1 apartment part ment of agriculture all cases of violations of the regulations I 1 in order that proper aati action ion may be taken the department of agrical i ture has no power to suspend the i law or to pardon violations of the regulations doubtless the erroneous impression on which the newspaper statements are b based ased has grown out of the ency of litigation involving thel the I 1 constitutionality of the act of afi congress approved march 4 41 I 1 1913 under which the regula 1 eions were vere promulgated the lower federal courts disagreed as to the validity of the statute and the issue was carried to the thea supreme court of the united states the case was argued in the supreme court in october 1915 but has not been decided following the lower court decisions ions congress appropriated money for the purpose of continuing the enforcement of the law the department of agriculture i inbound is bound to report to the department of justice violations of the regulations if the supreme court should declare the law constitutional A person sli should suld therefore be warned of the danger they incur from failure to abide by the regulations |
