Each lease is offered separately for a cash bonus in addition to the stipulated royalties and rental of $1.25 per acre per annum. The successful and responsible bidder for any lease will be required to pay in advance an annual rental of $1.25 per acre, his proportionate propor-tionate share of the cost of advertising, and a filing fee of $5.00 for each lease obtained and approved. A deposit of 20 per cent of the bonus bid and 20 per cent of the advance rental for the first year must accompany the bid and be in the form of a certified check or bank draft drawn on a solvent bank payable to the Treasurer of the United States. ACREAGE LIMITATION No individual, corporation, partnership, part-nership, company or association shall be permitted to hold under leases for oil ando.r gas mining purposes, restricted allotted or unallotted un-allotted Indian lands in any one State in excess of 10,240 acres in the aggregate: Provided, that the acreage leased by any officer or director of a company shall be charged against the company, and vice versa, and the acreage shall also be charged in the case of stockholders owning 40 or more per cent of the stock. The acreage of companies having common stockholders owning a majority of the stock of each company shall be charged against each other, or in the case such companies have one or more common officers or directors In all other cases each corporation will be considered a separate and distinct entity. The Sale will be held and the leases executed in accordance with the Act of May 11, 1938, (52 Stat. 347) and the regulations approved May 31, 1938, (25 C.F.R., Part 186) as to tribal lands, and the Act of March 3, 1909 (35 Stat. 781, 783) and the regulations ap-oroved ap-oroved October 8, 1937 (25 C.F.R, Part 189) as to allotted lands. Lease Form 5-157 (June 1939) will be used for tribal land leases and Lease Form 5-154h for allotted land leases. Failure of the successful bidder to comply with the terms of sale and the regulations will render his deposit liable to forfeiture in the discretion of the Secretary of Interior. Leases filed after 20 days from date of mailing to lessee for execution will be subject to revaluation of bonus if permission is granted for an extension of time. Sales will be cancelled and deposits forfeited at the expiration expira-tion of the 20 day filing period unless for good and sufficient reason an extension of the filing period is granted. The right is reserved by the Secretary of the Interior to reject any or all bids and to disapprove any lease made on an accepted bid Should any bid be rejected after deposit is made through no fault of the bidder, all moneys deposited will be returned. The term of the leases will be 10 years from Hhe date of approval by the Secretary "of the Interior and asmuch longer thereafter as the substances specified in the leases are produced in paying quantities. The lessee must furnish a satisfactory surety bond for each lease as required by the regulations, or a lessee may file one bond (Form 5-1 54F, August, 1940) in the sum of $15,000 covering up to 10,240 acres. , . ' Bids received will be referred to the Ute Business Committee on tribal lands for the recommendation of that committee as to acceptance or rejection before such bids are referred to the Secretary Secre-tary of the Interior for final action. Bids received on Allotted Indian lands will be referred to the owners of such allotments before further action is taken by this Office.
