NOTICE IS FURTHER GIVEN that pursuant to law for a period of thirty (30) days from and after the date of the publication of this notice, any person per-son in interest shall have the right to contest con-test the legality of the above described resolution re-solution of the City Council or the Bonds or any provisions made for the secureity and payment of the Bonds, and that after such time, no one shall have any cause of action ac-tion to contest the regularity, reg-ularity, formality or legality thereof for any cause whatsoever. WOOD City Recorder City of North Salt Lake Davis County, Utah Published in the Davis County Clipper on Nov. 7, 1985 Issue No. 40 C-486 NOTICE OF BONDS TO BE ISSUED NOTICE IS HEREBY GIVEN pursuant to the provisions provi-sions of Sectionl 1-17-16, Utah Code Annotated Anno-tated 1953, as amend-ded, amend-ded, that on November Novem-ber 5. 1985. the City Council of the City of North Salt Lake, Davis County, Utah (the "City Council"), adopted a resolution in which it authorized and approved the issuance of its Industrial Indust-rial Development Revenue Re-venue Bonds, Series 1985 (the "Bonds") in the aggregate principal amount of not to exceed ex-ceed One Million Five Hundred Thousand Dollars ($1,500,000), the proceeds of the Bonds to be loaned to John L. Babock and Norman R. Schoepf, residents of the State of Utah (collectively, the "Borrowers"), to finance the acquisition, acquisi-tion, construction, improvement, im-provement, and equipping equip-ping of certain facilities facili-ties suitable for manufacturing, manu-facturing, industrial and office building facilities, and other business purposes, and to pay costs and expenses incidental thereto and to the issuance of the Bonds. The foregoing project will be owned by the Borrowers and operated oper-ated by Nu-Art Lighting Light-ing and Manufacturing Company, Incorporated, Incorpo-rated, a Utah corporation corpora-tion (the "Lessee"), will consist of an approximately 120,000 square foot facility, approximately 100,000 square feet of which are to be used for the manufacture of outdoor out-door lighting equipment equip-ment and approximately approxi-mately 20,000 square feet of which are to be used as office building facilities, and will be located at 160 North 400 West, North Salt Lake, Utah. The Bonds are to be issued and sold by the City of North Salt Lake, Davis County, Utah (the "City") pursuant pur-suant to said resolution, resolu-tion, including as part of said resolution the draft of a final bond resolution re-solution which was before be-fore the City Council and attached to said resolution re-solution in substantially substantial-ly final form at the time of the adoption of said resolution, and said final bond resolution is to be adopted by the City Council in such form, with such changes thereto as shall be approved by the City Council upon the adoption thereof. A copy of said resolution re-solution (including the draft of said final bond resolution with Exhibits Ex-hibits A through H thereto, consisting, respectively, re-spectively, of an Indenture Inde-nture of Trust, a Loan Agreement, a Mortgage, Mort-gage, Security Agreement, Agree-ment, and Assignment of Rents, a Related, Mortgage, Security Agreement, and Assignment of Rents, a Personal Guaranty Agreement, a Bond Purchase Agreement, and an Inducement Letter) is on file in the office of the City Recorder Re-corder of the City at the City Hall, 17 South Main Street, in North Salt Lake, Utah, where it may be examined ex-amined during regular business hours of the City Recorder from 8:00 o'clock A.M. to 5:00 o'clock P.M.
