The acreage of companies having common stockholders owning a majority of the stock of each company shall be charged against each other, or in the case of such .companies have one or more common officers or directors. In all other cases each corporation will be considered a separate and distinct entity. The Sale will 1 be held and tht? leases executed in accordance with the Act. of May 11, 1938, (52 Stat. 347) and the regulations approved May 31, 1938 (25 C.F.R., Part 186) as to tribal lands, and the Act of March 3, 1909 (35 Stat. 781, 783) and the regulations approved October 8, 1937 (25 C.F R, Part 189) as to allotted lands. Lease Form 5-157 (June 1939) will be used for tribal land leases and Lease Form 5-154h for allotted land leases. Failure of the successful bidder to comply with the terms of sale and the regulations will render his deposit liable to forfeiture in the discretion of the Secretary of Interior. Leases filed after 20 days from date of mailing to lessee for execution will be subject to revaluation of bonus if permission is granted for an extension of time. Sales will be cancelled and deposits forfeited at the expiration of the 20 day filing period unless fo.r good and sufficient reason an extension of the filing period is granted. The right is reserved by the Secretary of the Interior to reject any or all bids and to disapprove any lease made on an accepted bid. Should any bid be rejected after deposit is made through no fault of the bidder, all moneys deposited will be returned. The term of the leases will be 10 years from the date of approval by the Secretary of the Interior and as much longer thereafter as the substances specified in the leases are produced in paying quantities. The lessee must furnish a satisfactory surety bond for each lease as required by the regulations, or a lessee may file one bond (Form 5-154F, August, 1940) in the sum of $15,000 covering up to 10,240 acres. Bids received will be referred to the Ute Business Committee on tribal lands for the recommendation of that committee as to acceptance or rejection before such bids are referred to the Secretary Secre-tary of the Interior for final action. Bids received on Allotted Indian lands will be referred to the owners of such allotments before further action by this office is taken. Only as such bids are approved ap-proved by such owners under the regulations can a lease be drawn.
