coughlin from tho the state prison salt lake city saturday and stayed that night in ogden the prisoner spending the night in tho prison there the s sheriff with the prisoner left ogden sunday morning arriving at woodruff about 5 pm p m where the party parly rested about an hour to thaw out randolph randol p h was reached soon after 7 p in and tho the prisoner lodged in the county jail the journey all through was uneventful the prisoner appearing cheerful with apparently parent ly no fear of his approaching doom lie ile however appeared a little nervous in Evang evanston Eva naton tort and showed relief when that town was left behind promptly at 10 a m monday INIn uday morning the prisoner was brought into court the judge 0 II 11 hurt hart ordered the prisoner to stand up tip the prisoner replied 1 I i will ill when these cuffs are taken off Sheriff Dickson relieved him blin of anti and he stood up his appearance created surprise as the people g generally Prie rally had been led to believe by tho the salt lake papers that the prisoner n was wag a prematurely prem maturely old gray head headid d man instead of which appeared a cool young man with hair black as jet if 1 ne e has any gray hairs on his head they are arc not noticeable at a distance of five feet tho the prisoner was remanded reir banded until e 16 a am m wednesday mornine morn aing when the date and time for execl r would be fixed coughlin app appeared elfed cool and col bete voice said he had paid an attorney 1000 to represent him and that he expected him to he here at 10 a m wednesday tile the prisoner was broucht before judge hart for the purpose of hearing earing li date and time for execution the prisoner stood up and the judge said in ing ping him it is 19 therefore ordered and adjudged that you patrick coughlin be taken from hence to some place of confinement until tuesday the day of Dc december ember 1896 and between the hours of 10 ocl ock in the forenoon and 2 in tho afternoon of the said last named jay day in the yard of the jail or place where you are confined or in some other private place within the judicial district you bo be shot until you aro dead coughlin stood firmly up while the dread sentence was being pronounced and betrayed no emotion whatever excepting a slight perspiration which started out on liis his forehead after Fen sentence tence had been pronounced the prisoner in a cool and deliberate manner said how many days is that judge judge hart replied six coughlin is very little time I 1 was allowed courty days before and I 1 have relatives I 1 want to see sea some of whom live 1000 miles from here sheriff dickson moved the prisoner in the midst of his protestations HISTORY OF THE CRIME tile the crime for which coughlin is to pay the penalty is the murder of deputy sheriff dawes and constable stagg earv early catly ly in the summer of 1895 coughlin who is about 23 years of age had a partner in the crime named fred george a youth of about 20 he was tried also for murder found guilty with coughlin but escaped the gallows and was given a life sentence which be is now nom serving in the penitentiary tertiary tent iary the two young men were accused of horse stealing and warrants for their arrest were issued and put into the hands i of the of officers ficere of summit county where that crime was committed the young men escaped to the mountains and were pursued by the officers who sighted them several beveral times both were well armed and never tailed failed to shoot at the ho officers when an opportunity offered i they made their way north over the mountains arriving in tile the neighborhood of evanston Eva naton wyo and took up a position in a cabin in rich county utah a little on this side of the wyoming state line stagg 3 dawes and other officers surrounded surround ed the cabin and called on the desperadoes to surrender but they replied with their guns glins killing stagg ind and dawes the other officers retreated and coughlin CouR hlin and george escaped and doubled on their tracks making their way south and arrived in the mountains east cast of salt lake where they entrenched themselves and kept at bay for many hours half the police force ot of salt lake and a crowd of deputy sheriffs they worked south and finally were captured in ill tooele thoele county without resistance they were tried in ogden for the murders rich kich county where the kill ing was done at that time being in the same judicial district as ogden both were found guilty and coughlin sentenced to be shot and george to life imprisonment EFFORTS MADE FOR LIFE appeal was vas taken to the supreme court of the territory of utah but the judg judgment pa ent C of af the dist court was on feb 24 1890 Affirmed A petition tion for rehearing reh earine was then filid filed in the supreme court state of utah and judgment given march 37 27 1596 denying petition on april 16 1896 defendant filed la in supreme court petition tor for writ of error from supreme court of state of utah to supreme court of united states same denied april 24 1896 on juna 5 1896 an order of the supreme court of state of utah was entered staying remittitur un on june the supreme court of the state of utah granted further stay of said remittitur for 10 days from date dale thereof application for wrt of error from supreme court state of utah to supreme court of united states or one of the judges thereof was presented to john M harlan associate justice of the supreme court of united states and by him denied supreme cobit of state of utah on september 22 1896 ordered said cause remanded to the proper judicial district out ilia his attorneys are now working with tho the board of pardons for commutation of the death sentence to one of life imprisonment NOTES judge hart visited tile the prisoner and shook hands with him before leaving the prisoners meals are supplied by the randolph hotel and he gets what he orders no one except the sheriff and ills his assistants si stants are allowed near the jail at night flight a password is used judge hart bart performed his very pain fal and unpleasant duty he first of the kind in a praiseworthy munner manner extraordinary precautions are being taken ag against 11 dinst escape or rescue of the prisoner toner two men are constantly in tile cell with him and a sentry armed continually patrols patrol 3 tho the outside of the jail there are also a number of armed men in the court house bouse which is only about 30 feet from the jail patrick coughlin was born at canton mass june jane 23 1874 he was therefore 22 years old last june he looks about eight years older ills his parents came to utah soon after the advent of the V ul P B R R and they have resided in park city ever since the prisoner has
