Show PRISON FOREMAN IS FOUND GUILTY FLORIDA PRISON CAMP FOREMAN FORE-MAN SENTENCED TO SERVE TWENTY YEARS Defense Contends Lashing Given N. D. Youth Was Within the Law; Pneumonia Death Cause Lake City, Fla. Thomas M. Higgin-botham Higgin-botham was found guilty of murder In the second degree for the murder of Martin Tabert of North Dakota, by a Jury here late Saturday. Iligginbotham was sentenced to twenty years imprisonment. He w-as released on $10,000 bond pending hearing of apieal. Iligginbotham went on trial here thirteen days ago, the state charging him with having whipped Tabert so severely that it brought traumatic pneumonia, which resulted in death four days after the whipping. The defense admitted the whipping, but contended it was "within the law," basing on this testimony adduced from witnesses that only eight to ten lashes were struck. The Florida convict camp regulations at that time permitted permit-ted administering as many as ten lashes. The defense contended Tab. j ert died from lobar pneumonia, using j the Putnam Lumber company's camp j doctor, T. Capors Jones, as a witness, j He testified there were no signs of traumatism on the liody when he examined Tabert. Six expert witnesses wit-nesses corroborated Jones.
