Show AN ORDINANCE AN ORDINANCE REGULATING THE ISSUANCE OF DANCE HALL LICENSES, PROVIDING MANDATORY PREREQUISITES PREREQUI-SITES TO THE ISSUANCE OF ANY LICENSE, GIVING THE CITY COUNCIL DISCRETION IN THE ISSUANCE OF SUCH LICENSE AND PROVIDING A PENALTY, TO BE KNOWN AS TITLE 5, CHAPTER 15, SECTIONS 1 THROUGH 9 INCLUSIVE. BE IT ORDAINED BY THE CITY COUNCIL OF PLEASANT GROVE CITY: DANCE HALLS TO BE LICENSED: 5-15-1. It shall be unlawful for any person to hold or conduct or to permit the holding or conducting of any public dance within the limits of Pleasant Grove City until the dance hall or other place in which the same may be held shall have first been duly licensed. PUBLIC DANCE DEFINED: 5-15-2. The term "public dance" as used in this ordinance shall mean any dance to which admission is available by paying a fee or by the purchase or presentation of a ticket or by the payment of a fee for dance music, or any other dance to which the general public may gain admission with or without payment of fees, but does not include any dance organized, supervised or sponsored by any charitable organization or non-profit corporation. cor-poration. CONTENTS OF APPLICATION: 5-15-3: All applications for licenses under this ordinance shall be verified and filed with the council and shall state the applicant's name and address in full, and if a partnership the names and addresses of all partners, and if a corporation the names and addresses of all officers and directors, and must be subscribed by the applicant who must certify under oath that all facts stated therein are true. AUTHORITY OF CITY COUNCIL TO REFUSE APPLICATION: 5-15-4. The council may, with or without hearing, in its discretion, refuse to grant any license under this ordinance and in no such case need any cause be stated. LICENSE REQUIREMENTS: 5-15-5. No license for a public dance hall shall be issued until it shall be made to appear to the satisfaction of the council that the place for which it is issued complies with all laws, ordinances, applicable health and fire regulations and is equipped with adequate ventilation and rest room and toilet facilities for either sex, and is a safe and proper place for the purpose intended. Every person to whom a dance hall license is issued shall post the same in a conspicuous place in the dance hall covered by such license. 5-15-6. Such license shall specify the location of the public dance hall and shall be revoked when it shall be made to appear to the city council that any dance hall so licensed is or has been conducted in an illegal, disorderly or improper manner or whenever a person conducting such dance hall has been convicted convict-ed of a violation of any of the provisions of this ordinance, or of any other city ordinance relating to public dances. No such license shall be revoked until a hearing shall have been had by the council in the matter. Written notice of such hearing shall be secured not less than three days prior to the date thereof upon the holder of such license, or his, or its manager or agent. Such notice shall set forth the grounds for the complaint against the holder of such license and the time and the place where such hearing is to be held. 5-15-7. It shall be unlawful for any person conducting or maintaining a public dance hall or having control thereof to conduct, carry on or permit any dance or dancing therein between the hours of twelve o'clock midnight of any day of the week other than Saturday, and six o'clock a.m. of the following follow-ing day, and between the hours of twelve o'clock midnight of any Saturday and six o'clock a.m. of the following Monday. All public dance halls shall be open at all times to the visits, inspections and supervision of any executive or peace officer of Pleasant Grove City. DANCE HALL LICENSE NOT TRANSFERABLE: 5-15-8. No license issued under the provisions of this ordinance shall be transferable and upon revocation thereof by the council, the fees paid by the licensee to the City for the license shall be forfeited to the City. PENALTY: 5-15-9. Any person who violates any of the provisions of this ordinance is guilty of a misdemeanor and shall be punished by a fine of not more than $299.00, or by imprisonment for not more than six months or by both such fine and imprisonment. imprison-ment. In the opinion of the City Council, it is necessary for the immediate preservation of the peace, health and safety of Pleasant Grove City that this ordinance take effect upon its first publication.
