Show court sentences three thre e to state prison at a regular law and M motion fotion day of the district court for this county held here on tuesday of this week judge will L hoyt sentenced three men to the state prison for terms not to exceed five years two of these were leroy A wilson and willis leland who were convicted oflas of assault sault with a deadly weapon at the may term of the district court but with both sentences bences deferred until now pending a motion for a new trial this motion was argued with henry houchen who served on the jury which convicted the men testifying along with defendants wilson and and a mr church churchtown town the motion was denied when the court was of the opinion that houchen was not biased the defendants then requested and were given permission to explain what they were doing toward supplying metal for the war effort then the judge passed sentence upon them but granted a stay of execution until the opening day of the next term of court on september 14 following an altercation in the court room during the recess houchen was again sworn and anc testified regarding what attorney foster said to him during the recess the court then reprimanded attorney foster and gave him until the opening day of the next term to produce witnesses to prove that houchen falsified in testimony if he cant do this he will be fined for contempt of court the other to receive a 5 year sentence was ernest lawrence who plead guilty to a carnal knowledge charge waived time and asked that sentence be passed immediately he was taken to the state prison that day by sheriff lamb and deputy sheriff adams he was represented in court by attorney durham morris with district attorney ellis pickett handling the prosecution he had been arraigned in a former term of court stanley mcknight was reported to be in arrears la in payments to the county clerk as ordered at the may term of the court and it was ordered that he appear at the next term on a charge of contempt unless he makes up the delinquent payments in the case of vs wilson lunt et a al a motion for a new trial was denied |
