Show v U J' vehicle upon any roadway for the principal purpose of: (1) Displaying such vehicle for sale. (2) Greasing or repairing such vehicle, except repairs necessitated by an emergency. emer-gency. (3) Displaying advertising. (4) The sale of foodstuffs or other merchandise. Section 1-12. PARKING ON NARROW STREETS. No person shall park a vehicle on any private or public street or alley where the width of the roadway is less than twenty feet. Section 1-13. PARKING ON SIDEWALK OR CURBING. CURB-ING. It shall be unlawful for any person to leave or cause to be left or parked any vehicle upon, over and across any public parking or sidewalk or that area between bet-ween the sidewalk and curb. Section 1-14. STOPPING, STANDING OR PARKING " IN HAZARDOUS OR CONGESTED CON-GESTED PLACES. When official signs or markings are erected at hazardous or congested places, no person shall stop, stand or park a vehicle in such designated places. Section 1-15. PENALTY. Any person who violates any provision of this ordinance shall be guilty of a misdemeanor misde-meanor and shall be fined not more than $299.00 or six months in the Summit County Jail, or by both such fine and imprisonment. Section 1-16. EFFECTIVE DATE. This ordinance shall take effect fifteen days after its passage. PASSED, APPROVED AND EXECUTED this 15th day of February, 1983. Whenever tne ponce officer removes a vehicle and causes it to be impounded as authorized in this ordinance and the officer knows or is able to ascertain from the registration, or other records in the vehicle or otherwise, the name of the owner and address of the owner thereof, such office shall give or cause to be given notice to such owner of the fact of such removal, the reason therefor, and the place to which such vehicle has been removed. Section 1-5. PARKING PARALLEL TO CURB. No person shall stand or park a vehicle in a roadway other than parallel with the edge of the roadway, headed in the direction of lawful traffic movement and with the right-hand wheels of the vehicle within eighteen (18) inches of the curb or edge of the roadway, except as otherwise provided in this article, or whenever the. snow, ice, or climatic conditions, condi-tions, and the angle of the roadway makes it impractical to park headed in the direction of lawful traffic movement. Section 1-6. ILLEGALLY PARKED VEHICLE TO BE MOVED. Whenever any officer finds a vehicle parked or standing upon a street in violation of any provisions of this ordinance, such officer is hereby authorized to move such vehicle or require the driver or ' other person in charge of the vehicle to move the same to a position off the main-traveled part of such street. Section 1-7.. STOPPING OR PARKING ON STREET OUTSIDE BUSINESS OR RESIDENTIAL DISTRICTS. (1) Upon any street outside of a business or residential district, no person shall stop, park or leave standing any vehicle, whether attended or unattended, upon a main-traveled main-traveled part of the street when it is practical to stop, park or so leave such vehicle off such part of such street, but in every event, an unobstructed width of the street opposite a standing vehicle shall be left for the free passage of other vehicles, vehi-cles, and a clear view of such stopped vehicle shall be available from a distance of two hundred (200) feet in each direction upon such street. (2) This section shall not apply to the driver of any vehicle which is disabled while on the main-traveled portion of a street in such manner and to such extent that it is impossible to avoid stopping and temporarily leaving such disabled vehicle in such position. Section 1-8. PROHIBITED IN CERTAIN PLACES. (1) No person shall stop, stand or park a vehicle, except when necessary to avoid conflict with other traffic or in compliance with law or the directions of a police officer or traffic-control device in any of the following places: (A) On a sidewalk. (B) In front or within five feet of a private driveway. (C) Within an intersection. (D) Within five feet of a fire hydrant. (E) On a crosswalk. (F) Within twenty feet of a crosswalk at an intersection. (G) Within thirty feet upon . the approach to any flashing beacon or traffic-control device de-vice located at the side of a roadway. (H) Between a safety zone and the adjacent curb or within thirty feet of points on the curb immediately opposite oppo-site the ends of a safety zone unless authorized signs or markings indicate a different length. (I) Within fifty feet of the nearest rail of a railroad crossing. (J) Within twenty feet of the driveway entrance to any fire station and on the side of a street opposite the entrance en-trance when properly signposted. sign-posted. (K) Alongside or opposite any street excavation or obstruction when stopping, standing or parking would obstruct or be hazardous to traffic. (L) Upon any bridge or other elevated structure upon a street , or within a street tunnel or underpass. (M) At any place .where official signs or traffic markings prohibit stopping, standing or parking., (N) With the left-hand side of the vehicle, to the curb, except as otherwise permitted permit-ted on one-way streets and except whenever the snow, ice, etc., and the grade of the roadway makes it impractical to park headed in- the direction of lawful traffic. (2) No person shall move a vehicle not lawfully under his control into any such prohibited prohi-bited area or away from a curb such distance as is unlawful. Section 1-9. PARKING NOT TO OBSTRUCT TRAFFIC, TRAF-FIC, SIDEWALKS, DRIVEWAY, DRIVE-WAY, ETC. (1) No person shall park any vehicle upon a street in such a manner or under such conditions as to leave available avail-able less than twenty (20) feet of the width of the roadway for free movement of vehicular traffic. (2) No person shall park any vehicle in such manner or under such conditions as to obstruct any sidewalk, crossing or private driveway. Section 1-10. PARKING MORE THAN SEVENTY-TWO SEVENTY-TWO CONSECUTIVE HOURS PROHIBITED. No person who owns or has possession or control of any vehicle shall park such vehicle upon any street or alley for more than seventy-two seventy-two consecutive hours. Section 1-11. PARKING FOR CERTAIN PURPOSES PROHIBITED. No person shall park or operate a ORDINANCE NO. 131 THE BOARD OF COUNTY COMMISSIONERS COMMISSION-ERS OF THE COUNTY OF SUMMIT ORDAINS AS FOLLOWS: Section 1-1. DESIGNATION. DESIGNA-TION. This ordinance shall be designated as the Summit County Parking Code. Section 1-2. AUTHORITY TO REMOVE; SITUATION ENUMERATED WHEN REMOVAL RE-MOVAL AUTHORIZED. (1) Members of the Summit Sum-mit County Sheriffs Department Depart-ment and Utah Highway Patrol are hereby authorized to remove, or have removed at their direction, a vehicle from any street, alley, highway, roadway, sidewalk, ditch or other public way or place, and from any restricted restrict-ed or prohibited parking area, under any of the following circumstances which are deemed to be obstructions to traffic and public nuisances. Such vehicles vehi-cles shall be subject to removal under the section.. (A) When any vehicle is left unattended upon any bridge or where such vehicle constitutes an obstruction to traffic. (B) When a vehicle upon a public way is so disabled as to constitute an obstruction to traffic and the person in charge of the vehicle is by way of physical injury, illness, under the influence of alcohol, or incapacitated to such an extent as to be unable to provide for its custody or removal. (C) When any vehicle is left unattended upon a street or is parked illegally so as to constitute a definite hazard or obstruction to the normal movement of traffic, or left v unattended on any public street with engine running or with keys in the ignition switch or lock. (D) When any vehicle is parked or left standing upon any area or portion of public street in violation of or contrary to a parking limitation limita-tion or prohibition established establish-ed by Summit County or the State of Utah provided such area or portion of such public street has been posted with an official sign giving notice of limitation or prohibition. (E) When a vehicle is left parked at the same place continuously for a period of seventy-two (72) hours. (F) When any person has been taken into custody by the Summit County Sheriffs Department or Highway Patrol and the vehicle would thereby be left unattended on a street, highway, or restricted parking area or other public way. (G) When the driver of a vehicle is reasonably sus pected of using license plates or license permit unlawfully, or a vehicle is drive or parked without proper license permit, per-mit, or driven or parked without proper license plates or license permits, or with no license plates or license permit, or driven or parked with an invalid or expired license permit. (H) When the driver of a vehicle is driving without an operator's license, or chauffeur's chauf-feur's license which is current and valid or who does not have such license in his immediate possession, or drives a vehicle while his operator's license or chauffeur's chauf-feur's license has been denied, suspended, canceled cancel-ed or revoked by the state. (I) When a vehicle is found parked on or so near to any railroad track as to block the same in any manner. (J) When the driver of any vehicle or the vehicle which he is driving is reasonably suspected of having been involved in any hit and run accident. (K) When the driver of any vehicle is taken into custody for a suspected felony or misdemeanor, or when the vehicle is suspected of containing stolen goods, or other contraband. (L) When any vehicle, by reason of having no muffler, or a defective or inadequate muffler, or a. muffler which has been modified in such a manner as to amplify or increase the noise emitted by the motor of such vehicle above that emitted by the muffler originally installed on the vehicle, and said vehicle emits an excessive or unusual noise. (M) When any vehicle is reasonably suspected of being be-ing a stolen vehicle or parts thereof to be stolen parts. (N) When a vehicle is parked upon private property without the permission of the owner thereof. (O) When a vehicle which is longer than fifteen (15) feet in length is parked upon any public street or alleyway within Summit County where such vehicle constitutes an obstruction or hazard to the normal movement of traffic. (2) It shall be unlawful for any person to park, situate or place a vehicle in circumstances circum-stances constituting a violation viola-tion under any provision of Section 1-2 hereof. Section 1-3. CHARGES FOR RELEASE. No vehicle removed and stored or impounded as provided for in this article shall be released until the charge for towing or otherwise removing such vehicle together with a charge for storage of the same, shall have been paid. Section 1-4. NOTICE OF OWNER OF IMPOUND- |
