concurring therein section 1 that it is proposed to amend section 17 article 7 ot of the constitution ot of the state ot of utah so that the same will read as follows 17 the auditor shall bo be auditor of public accounts the public mon ag yg shall be deposited by the tr treasurer aas under the supervision of the board of examiners and as pr provided 0 vid by law sec 2 the secretary of state la is hereby directed to submit this proposed amendment to tho the electors 0 or f the state at the next general election in the manner provided by law see sec 3 if I 1 adopted by the electors of 0 article 13 of the tha constitution of the state of utah relating to revenue and taxation bt it resolved by the legislature of the state of utah two thirds of all members elected to lo each of the two houses concurring therein section 1 it Is proposed to amend article 13 of the constitution of the state of utah so that the samerill sama same will road as follows follow 1 the po power of taxation shall nevet I 1 ur rendered suspended or contracted away all taxes shall be uni uniform forin upon the same class of property within the territorial terri lorial limits of the authority levying the tax and shall be levied and collected for public purposes only 2 the legislature shall provide by law tor for an annual tax sufficient with other sources of revenue to detray defray the estimated ordinary expenses of the state for each fiscal year for the purpose of paying the state debt if any there be the legislature shall provide tor for levying a tax annually sufficient to pay the annual interest and principal of such debt within twenty years from the final passage of the law creating the debt 3 there shall be ba exempt from taxation property of 0 the united states of the state counties cities towns school districts municipal corporations and public libraries lots with the buildings thereon used exclusively clu tor for either religious worship or charitable purposes and places of burial not held or used tor for private or corporate benefit ditches canals reservoirs pipes and flumes blumes owned and used by individuals divi duals or corporations tor for irrigating lands owned by such duals or corporations or the indi individual vidi 1 members thereof shall not be separately taxed so long as they shall he be owned and used exclusively tor for such purpose provided that mortgages upon real and personal property shall be exempt from taxation and nd that the taxes of 0 the indigent poor may be remitted or abated at a such time and in such manner as may be provided by law 4 the legislature shall riot not impose taxes for the purpose of any county city town or other municipal corporation but may by law vest in the corporate authorities thereof respectively ively the power to assess and collect taxes tor for all purposes ot of such corporation 5 the surface ground ot of all mines and mining claims both placer and rock in place containing or bearing gold silver copper lead iron or other valuable metals lifter after purchase thereof from the united states shall hall be taxed at a valde a not greater than the price paid the united states unless the surface 1 ground around or some part thereof of such mine or claim Is used for other than mining purposes and has a separate and independent value tor for such other purposes in which case said surface ground or any part thereof s so 0 used for or other than mining purposes shall be taxed at its value for such other purposes as provided by law and all machinery used in mining and all property and surface improvements upon ilion or appurtenant to mines and mining claims which have EL a value ep arate parate and independent of such mines or mining claims shall be taxed as provided by law all lands containing coal granite stone marble yx gas oil hydrocarbons hydro carbons gypsum or other 0 her valuable mineral deposits other than those enumerated above in this section after purchase thereof from the united states and all property and surface improvements upon or appurtenant to such lands hall be taxed as provided by law 1 in 13 addition to the assessment of tile the araco grounds improvements ani machinery of mines and mining faints claims all mines and mining claims producing net proceeds chail lie he tl id w at a value not to exceed three bojes liea such net proceeds 6 an accurate statement of the receipts and expenditures of the pub lie e moneys shall be published annual ly y la 1 I such manner as the Leg legislature legislate islat ure ilay y provide 7 the rate rate ot of taxation on pro rony porty for or state purposes shall never exceed eed eight mills on each dollar of Y a to be be apportioned as lol fol lows iowa not to excena and one halt mills on each dollar of balu yalu valuation for general state purposes not to exceed three mills on each dollar ot of valuation for district school purposes not to exceed one halt half mill on each dollar ot of valuation tor for high school purposes that part ot of the state tax apportioned to high school purposes shall constitute a fund to be called the high school fund and shall be apportioned to the cities and school districts maintaining high schools in the manner the legislature may provide and whenever the taxable property properly within the state shall amount to four hundred million dollars the rate shall not exceed the he mills on each dollar ot of valuation unless a proposition to increase such rate specifying the rate proposed and the time during which the same shall be levied be first submitted to a vote ot of such of the qualified electors ot of the state as in the year next preceding such election shall have paid a a property tax assessed to them within the state and the majority ot of those voting thereon shall vote in favor thereof in such manner as may be provided by law 8 the making ot of profit out ot of public moneys using flie cie same for any purpose not authorized by law by any public off officer icer shall be deam ed a telony felony and shall bo be punished as provided by law but part of such punishment shall be disqualification to hold public office 9 no appropriation shall be made or any expenditure authorized author lied by the legislature whereby the expenditures tures of the state during any fiscal year shall exceed the total tax then provided tor for by law and applicable tor for such appropriation or expenditure pend iture unless the legislature making such appropriation shall provide for levying a sufficient tax not exceeding the rates allowed in section 6 of this article to pay such appropriation or expenditure within such fiscal year this provision shall not apply to appropriations or expenditures tures to suppress insurrections defend the state or assist in defending the united states in time of war 10 nothing in this constitution shall be construed to prevent the legislature from providing a stamp tax or a tax based on income licenses or franchises see sec 2 the secretary of state Is hereby ordered to give this proposition to be published in at least one newspaper in every county in the state where a newspaper is printed and published tor for two months preceding the next general election see sec 3 this shall be submitted to the electors of this state at the next general election tor for their approval or disapproval all AH official ballots used at such election shall have printed or written thereon the words for the amendment of article 13 of the constitution relating to taxation yes no and shall otherwise be prepared and submitted to the electors as may be otherwise provided by law and said ballot shall be received counted and canvassed and returns thereon be made in the same manner and in all respects as in or may be provided by law in the case ot of election of state officers see sec 4 it if adopted by the electors ot of the state this amendment shall take effect january 1 1917
