with his advice and lions the new liquor ordinance which has been hanging fire tor for several meetings past way was again laid over until certain phases of the 1911 liquor law could be zone gone deeper into by the city attorney as regards drug store and restaurants tile the ordinance repealing the present ordinance per tain ilIg to tile the appointment salary and duties of the city attorney came up for its third read jug ine and was passed councilman thompson rC ompson lacing icing the only one voting against 0 its passage As it now stands the city is without a city attorney and the council is at perfect liberty to ilire hire whom it pleases to do its legal work and to pay what it pleases for i uch service the session after the roll call the minutes of the previous meeting were read and approved on motion of Council councilman mala thompson a warrant for was wag drawn in favor of the silver kin king for january water rent and in in favor of the water department for the water used by the city in january asks aski for a reduction mrs R B ivie petitioned the councillor council for a reduction in tier her wafer r rental anit al because of certain connections not being in use the matter was referred to the committee on fire and water reports favorable chairman mcgill of the fire and water committee to whom was referred the proposition of welsh driscoll and buck to make certain connections to tile the city water mains for fire protection in their establishment reported favorable the fire protection system which is something new for park city is to be installed at at the expense of the petitioners petition ers under irader the supervision of the city the committee leing being of the opinion that the proposed system would not only b bo of benefit to firm installing it in case of fire but to adjacent pro p pirty arty as well wants use of water chairman of the city property whom was referred the request of a mr robinson for the use of the waste water of the city that was discharged on the flat below town asked for further time to report mr F P V clayt superintendent of the mackintosh sampler was present anil informed d the council that the sampler er had been using tho tha water for at least seventeen years perhaps twenty and it was necessary that conditions regarding that water remain unchanged that the sampler had no tire fire protection other than cian this water that the water being only waste he questioned the right of the city to give same to third party the gentleman was informed that the matter would be given careful consideration by the committee and all parties interested inter estol dealt fairly with before final a action was taken the new ordinances under unfinished business the new ordinances came up for consideration councilman smith was of the opinion that the clause in the liquor license allow in in restaurants to secure a ii cens cenap for OOOO should be eliminated ani and moved an amendment to that effect this called forth a dispels discussion ion as to the intent of tile the statutes regarding this matter and on motion of thompson the ie ordinance was wag laid over until next in order that tile the attorn attorney ev might properly in tei the statute datuto regarding restaurants tau rants tR and drug stores the committee on law reported favorably on the ordinance I 1 relating to the abolishment of the office of the city attorney and recommended that the same come up for its third reading and passed thompson did not approve of the recommendation and asked the committee to give reasons why tile the present ordinance should be repealed megill said that tile the principal reason was that it conflicted with the state statutes that it would be a saving to the city if it was free to hire attorneys when necessary and to dispense with their services when there was nothing for them to do that in the past import ant work had been bungled by tue tile regular city attorney referring to recent water bond election and other matters that the city had never observed taw clau sebut had always paid extra when extra work was done and hired extra legal talent when cases had been tried in the dis brict court etc in favor of repeal councilman paull was of the same saine opinion as mr megill mcgill he was opposed to the ordinance as it now stood blood he believed that thai tile the council should be free Us as regards securing legal advice when important cases were to be tried lie he believed in in securing scouring tile the best obtainable in behalf ut of th tho city in that thai way cases might be won occasionally occasion aly hild and money saved in thelong run thompson said this would prove very expensive to the city and though home definite plau plan should be decided upon by the council regarding an att attorney orue to look after its legal affairs before repealing the present ordinance di nance ile he admitted that mistakes had been made by former er attorneys employed by tile the city attorneys were not the ones connected with nth the city administration that had made mistakes luib however and there wa was 6 no assurance that mistakes would not be made by attori attorneys leys in the future no matter what salary was paid attorney evans favored the repeal he gave as his opinion that the city would get better service at a less cost than at present prent A general discussion followed participated in iii by the mayor and all the councilmen and when ii a vote was finally called for mr thompson was the only nay against the repeal new business under this head mayor welsh said new contract prepared by attorney Attorn ev evans to be submitted to the kin king coalition company for tile the wa water ter being furnished the city for its new system was read it binds both parties for a term of ten years at a monthly rental of on motion the contract was ordered forwarded to the silver king company for approval in which event it will be duly signed by the proper city cita resolution fe recently adopted by the council to increase the water rent of the small users and allow the big users such as the railroad companies mills etc to derive the benefit of the reduction made by tile the old council both mcdill and paull expressed themselves emphatically that the resolution mentioned was intended to restore the water rental as it was prior to december 1st ast 1911 it was not intended to show partiality to either big or little users it was proved that the reduction made by the old council caused a deficit in the water department and it was to overcome this that the increase had been made by the present council mr paull further stated slated that the collim commit itce cc intended to adjust rates so thal thai all users whether great or small were treated fairly and justly b by Y being made to pay a uniform ill price as near as possible the work of revision attorney evans was asked liow how work was progressing in the revision I 1 on of tile the city cost lie he said the entire work would not exceed and perhaps much less than that cow bell nuisance councilman smith stated that many complaints hail had been made to him by men working on night shift read from city attorney P C evans regarding the taxing of tea and coffer coffee vendors and other solicitors doing business in park city without a license it was to to tin tile effect that where goods were shipped from salt lake and peddled here or where original packages were received from outside the state and then broken and the contents distri distribute butO among customers the vendors were subject to a city tax and should be compelled to pay it it was suggested that the city marshal investigate tile the methods metho cs these vendors vendor s and by so d do ing 1119 many would be found that could be compelled to take out a license this advice will be followed this concluded the business and the thompson motion was put and carried and the meeting adjourned |
