Show BOUNTY certificates opinion of attorney general as to order of payment an opinion was given monday by attorney general breeden to state auditor edwards in res response ponso to an inquiry as to the order of paying bounty certificates it Js JB the opinion of tho the attorney general that no preference should be shown in tho the order of payment regard regardless lesi of the tion of the certificates but that tho the rule of first come first served should be observed the opinion aDric concludes ludes by saying section Soctt on 3 imposes a duty upon tho the state board of examiners examine rg after it has examined the report submitted by tho the estate auditor under the provisions of section 2 2 of this chapter and after it iras iraa determined erminea det the character of tho the certificates as to being bonafide or fraudulent the findings of the board baard together with said certificates shall be filed with the state stale auditor and paid in accordance with such stich findings that Is to say the holders of the bonafide certificates to be paid haidn m full and the holders of the fraudulent onesi ones to be paid the actual amount which they paid tor for such certificates I 1 can see no good reason why there should be any preference sh shown awn in the payment of these certificates sinco since the legislature has authorized all of them to be paid on equal terms you ire are therefore advised that in my opinion the ahe certificates approved proved op by the board of examiners and ordered paid should be paid as they aro are presented at youn it if the appropriation becomes exhausted those holding unpaid certificates will be required to wait until tho the next session Res slon of the legislature when undoubtedly in an appropriation will be made to poy pey them |
