general land office at washington by governor cutler yesterday yester dav use state of utah will not be entitled 0 o the school sections in the townships in the uintah indian in lieu of sections 2 ag 32 and sa which bad been set apart for school purposes the state will be allowed to select four sections of land from each township where such landaas land has not bolh been appropriated alid department part ment of the interior contends the land is vested in the united slates and bylaw should be used tor the interest of the indians this means a loss of several bund rod thousands of colars to the school funds in utah even giving butali the right of indemnity Is far from satisfactory as the state can only get what Is left after the reservation is opened and apportionments made th a matter will be referred to at torney general breeden and stops taken for utah to secure some better advantage A protest will undoubtedly be made by the state to secure a better concession the following are the essential points covered by the opinion of the commissioner ot the general land ol 01 flee 1 hlll the state of utah take uie to the four designated school sections of lands in each township in said reservation 2 it the title of the state to said sections will not vest under the bernid of the grant will the stale be entitled to indemnity 8 if the state shall be entitle J 0 o indemnity for said designated sections or any part thereof may such indemnity bo selected from tha lands within the restored reservation the lands within the uintah in utah have always been a part of the public domain subject to the control of the congress without agreement or stipulation with the indians they are and have not been since the act of may 3 1861 supra public lands of the united states tn the sense that they are subject 0 o babeor other disposal under general jaws there no room tor doubt but that the right of indola since may 3 1902 both und erthe act the state into the union and the geneal act of february 28 1891 mada applicable to the state of utah by act of may 3 1902 and there Is nothing in any of the acts concerning these auda to indicate an intention on the part of congress lo 10 curtail the gram to state and no such intention can be presumed it therefore follows that unless the title of the state lias or will become vested to the in place the right of the state to indemnity for these sections is HOT impaired tho distinction if there is any Is that as to these lands the title and elgh of possession has never booi out of the united state notwithstanding they have by consent ot congress been subject to the indian right of occupancy and aro flow to be disposed cl fo their benefit the basic principle of the opinion however la that both acts the one making the grant zo tha state and the other creating a cunil funil for the indians should be without impairing either the ragn of the state or tho interest of tho indian and in the opinion of the court jhb state must resort to the indemnity provision of the granting net further the commissioner states ahta the act of march 3 1903 11 the disposal of these lands operated to preclude the stata frera taking sections 2 16 32 and within the townships within said reservation but it did not operate to lui pair the right ot the state to celeo indemnity for all granted school soc alons disposed of orto the time Us grant attached it follows also that no disposition 0 the lands can ibe made that will impair the interest of the Indian 1 these lands are 10 ax alon by the state as indemnity hill must be disposed of inthe manner and for the purpose designated by congress it is concluded says the report 0 i that the state of utah does boc take title to within the uintah reservation 2 that iha state is select other lands tn lieu of such sections as being lands otherwise disposed of bv and under of an act of con gressa gress 1 and the state is not entitled to make such select lond oi land within the
