was the first witness for the state ho testified that he was up at the hermitage on friday night when the fight occurred between young itono stono and harry moss he was standing with several other boys near the saloon and claimed that while moss was walking between the saloon and the dance hall he picked up a rock and threw it in the direction of stone and his friends As soon as moss got near stone an altercation ensued and they came to blows inthe first eu moss got worsted and retreated behind slater malang the remark you are a nice kind of a man to pitch on a drunken man horr claims that moss tried to get slater to take up the fight for him A second encounter ensued and he stated that stone pushed the fight as moss waa breaking ground rushes moss was thrown to the ground and stone commenced pum melang him in reply to questions by attorney H H handerson Hc horr stated that chas R hancock attempted to pull stone from oft moss but wilson grabbed hancock and pulled him away and tried to throw him to the ground immediately after hancock was pulled away stone jumped up making the remark im cut and threw his hands up to his neck after the occurrence attempts were made by seymour dark and chas R hai cock and others to stanch the flow of blood horr stated clial no remarks were made by stone as to who did the cutting dr J H gordon stated that mr stone was brought to his bouse about 1230 saturday morning at first he thought the wounds were not serious but he soon perceived that the young man was seriously cut pressure was applied and the hemorrhage stopped As soon as possible after the stoppage of the flow of blood the injured man was taken to the hospital dr gordon described the wounds he found upon young stone there were three in all one on the angle of the jaw one that partially severed the internal jugular vein and a third that completely steered the external carotid artery in his judgment the wounds opre caused by a sharp instrument probably a kelto he said that it was strange that mr stone died before arriving at his home robert JL emhe two boys who drove up the cannon with young stone on the night of the brou trou ble next gave testimony he stated
