Show S 1 l TRIAL THE DAY HAS BEEN CONSUMED IN GETTING A JURY AND PANEL IS NOT COMPLETE I 1 case will probably occupy most of the day tomorrow also j 0 I 1 the case of the state of utah vs S W knox charged with assault with intent to commit rape came up for hearing before judge and a jury in the district court today 1 most of the entire day was consumed in securing a jury and at a late hour this afternoon the testimony of the few witnesses for both state and defence began very large number of f were present most of whom were young railroad men friends of the defendant fen dant who was employed by tho southern pacific company when arrest pd at the opening of court thi morning the attorney for the defense filed a demurrer in it was stated tho complaint did not state facts sufficient to constitute a cause of action the demurrer was overruled the attorney for the defence stated eliat he would want a venire of jurors to select a panel from ho understood that there were not in this action ilia request for a full venire was denied the court stated all that had been were excused under statutory causes the complaining witness mis ethel smith was incourt in pincourt court with her father and great interest manifested in the examination of the jurors byall at the closing of this report fifteen jurors had been called to the jury box the following eight were being examined bv the state N J thomas W S 1 lewelling Rit chic J W bott jolin manning win M raymond ilott M toy and A C the state was represented by district attorney a |
