Show TILLMAN AND ARE CENSURED BY THE words of apology spoken by tillman cause a change of votes on the committee resolutions of censure democrats present a minority report washington feb 28 when the ken ate was called to order today a notably large attendance of senators was on the floor and the galleries were thronged thron ged both senators mclaurin and tillean Till Kan of south carolina were in their seats great interest was manifested by senators on the bloor and by spectators in the gallery in the reading of the journal which contained the protest af pf mr till nian against not being permitted to ato while under the ban of the senates order of contempt mr burrows of michigan chairman of the committee on privileges and elections immediately after the journal was approved addressed the chair saying that by direction of alie committee be was instructed to make a report on alie controversy arising out of the personal altercation on alie floor of the senate between senator tillman and senator mclaurin by order of alie senate the subject had been referred to alie committee on privileges and elections and the following resolution had hucia formulated by the committee that it is the judgment of tho senate that the senators from south carolina benjamin R tillman and john L mclaurin for disorderly behavior and flagrant violation of the rules of the senate on the day of february deserve alie censure of the senate and they arc hereby censured for theft breach of the privilege and dignity of athla body and from and after the adoption of this resolution the order adjudging them in contempt of tho senate shall be no longer in force and effect after the reading of the resolution by alie clerk mr burrows presented the report of the majority of alie committee saying in that connection it waa under 1 stood that those members of the committee who did not agree with the majority should have opportunity to their views mr mccomas of maryland said lie would submit the views ol 01 the minority the report of the majority was then acad the report cited the history of the altercation ter cation in the senate and quoted the language then used by alie offenders all agreed to this statement the re port then continued as follows that the conduct of the two sena tors was an on the vilt ege of alie senate a violation of its rules and derogatory character tending to bring alie body itself into public contempt cannot be questioned or denied indeed the senate by a unanimous vote has already placed on record its condemnation of the senators by declaring bolli guilty of contempt the majority of the committee are of the opinion that effort of adjudging these senators in contempt of tho senate was to suspend their functions as senators and eliat such a punishment for disorderly behavior was clearly within the hands of the senate but the conclusion aliey have readied makes it unnecessary to discuss this question the of lenses committed by the two senators were not in the opinion of a majority of the equal gravity the charge made by air tillman had been once before in tle senate specifically denied in parliamentary language by mr SIc Laurin charged against McLaurin SIr was among the most a senator should commit had lie ignored it or failed to reply he need not have to bo longer respected as either a man or a senator mr mclaurin did not commence the encounter but only stood in his place at his desk where ho was speaking and resisted the attack that was made upon him in other words was confined to the use of language for which he had unusual provocation nevertheless his offense was a violation of the rulea of so serious a character that in the opinion of the committee it should be condemned in case of mr tillman the record shows that alie altercation was commenced by the charge he made against air mclaurin suh a charge is inexcusable except in connection with a resolution to investigate ir tillman not only niad e without any avowal at a but also disclaimed knowledge of evidence to establish the offense and this he said after the charge had been specifically and unqualifiedly denied by sir mclaurin hsuch a charge under any circumstances should be resented by any man worthy to be a senator but made as it was in this instance its ou wag greatly intensified and the result roust leavo been foreseen by sir till nun if ho took any thought as ho sli of alie consequence ot his menta this feature of his offense offe nae coupled with the fact that ho also commenced alio encounter by quitting liis seat some distance away from sir mclaurin and rushing violently upon him struck him in the face makes the case one of such exceptional misbehavior that a majority of alie committee arc of the opinion that it is of much greater gravity than that of mr the penalty of a censure by alio senate in alie nature of things muff vary in actual severity in proportion to the public sense of the gravity of the of fence of which the offender bo adjudged guilty therefore notwithstanding alie fact that in the opinion of the majority their is a difference in the gravity of the under consideration your committee is of the opinion that public good and alio dignity of the senate will alike be best promoted and protected so far aa this particular case is concerned by imposing upon each senator by formal vote the censure of the senate for the b him committed and therefore recommend alie adoption of the resolution at the conclusion of the reading of alie majority report sir bailey offered the Jol lowin statement as representing alie views of himself and four other senators as follows we dissent from 0 o much of the report as the power of the senate to suspend a senator and thus deprive a state of its vote and so much as describes the
