Show GARTERS STEALS TUB ATLANTIC construction CO bobbed THE government new york july 9 hearing was resumed today before united states commissioner shield for a removal of ibe cases of E H gaynor and others accused of conspiring with captain ob erlan M carter to defraud the united states government to the jurisdiction of georgia federal courts thomas J agnew was tha first witness he was in te contracting firm of E II 11 hunting co in savannah in 1894 and told of the difficulty his firm had in securing a copy of the specifications of captain carter he identified a letter or protest written to captain carter under date of september 21 1893 mr agnew saad he called at the government office and the clerk told him ahe specifications bould only be obtained from captain carter he was unable to secure access to capt carler the were sent to him some days after he sent his letter of protest they were obtained through the influence of a friend hunting co made a bid at the last moment E H gaynor offered him the witness said to refrain from putting in a bid he declined to accept the money and john gaynor told him he had better take it he then said he ant into the engineers office and ew three sealed envelopes endorsed bids on capt carters table ed gaynor witness eald walked to the table and took up one envelope and substituted another al i for it that was about two minutes of 12 and at 12 capt carter opened the bids he said he supposed all bids except bis own were made for the atlantic construction company and that the last put in and presumably tho lowest would not have been put in had he consented to accept the offered to him J W Ost lery former chief clerk in the engineers department identified certain letters and contracts aa part of the records of the states engineers department the papers corroborated portions of mr agnese testimony |
