Show BEATIS CASE he was charged vilh the murder of thomas sandall charge dismissed on motion of county attorney streeper of bavis county attorney weber for beavis demands a tr nl this morning aa incident occurred in the second district court before judge maccarthy which will be a surprise to those who have watched tho action of the dails county officials in the case of the state against L U reavis charged with the murder of thomas sandall at layton a year ago county attorney streeper of dails county came to ogden this morning appeared in court and moved for the dismissal of the charges against as A J weber who was recently appointed in the case objected to the court granting the motion insisting that the man had spent several months in jail under the charge of murder and that he was entitled to a jury trial and an acquittal judge maccarthy granted the motion and a few minutes later reavis was notified that be was tree he was tickled to learn that all the trouble was over and he Is now walking the streets a tree man reavis has been a model prisoner since his removal from the farmington jail to ogden and the officers have trusted him on many occasions the case upon which reavis was held was a noteworthy one some time in april 1899 thos sandall an old man way murdered at layton and there was tittle or no clue to the murderer or murderers the officers labored for almost a year and finally arrested nick haworth in oregon haworth was a horse trader and had been at and around ogden all of that spring he was brought back to davis county where he was tried found guilty and sentenced to death the case la now on appeal to the supreme court on a motion for a new trial the probable cause being alleged as prejudice against haworth in dails county which prevented him having a fair trial at the conclusion on during the trial of haworth reavis was arrested in california and brought back he was examined and bound over september 11 by justice galley at layton A change of venue wai wa i secured by his attorneys and he was drought to ogden for trial and lias lisen in jail here since reavis today insisted that he was with haworth all of the night upon which the murder was committed and that both haworth and himself are innocent of the charge his trial was set for monday next |
