Show A NEBRASKA CASE law passed guarantee company bonds Is unconstitutional lincoln neb dec 11 an opinion rendered at the inquest of governor holcomb by attorney general churchill caused surprise almost tiou among incoming state officials to day it is in effect that the law parsed by the last legislature allowing detate county or city officers to give bonds furnished by guarantee companies ia unconstitutional this conclusion ot the attorney general may have an important bearing on the action of incoming state officers it lias been reliably reported that elate treasurer elest proposes to be prepared for any emergency by pre centini sen tini to the governor and other officials whose duty it is to pass on his bond two bonds one executed by guarantee companies and another signed by citizens of the state it has been claimed by supporters of the incoming administration that the state would have no right to pay the fee de minded by guarantee companies in such a case and that the treasurer himself cannot afford to pay the fee because it would amount to more than his salary the contention of tha attorney general is that be a personal surety without cost to the state though admitting that there are elements of doubt in the question the validity of bonda now in force furnished by these companies is not brought into question though they may be later |
