Show THE the miners caso case on trial before the federal court BOISE CIT CITY y idaho june 0 special to TUB titz STANDARD 1 in the federal court today the tile case ce of the union mine against the ill miners iners union came up on oil an order to show cause why an injunction should not be granted pending ing auit suit for or a perpetual in junction frank canahl appeared for the miners union and judge I 1 albert ilagan for I 1 I 1 I 1 I 1 I 1 I 1 1 1 I 1 IV I 1 I 1 I 1 1 1 I I 1 I 1 the plaintiff ganahl moved to dissolve the injunction on oil the that judge beatty could not issue an ini injunction unction at his ills chambers that it could not be issued without notice to the defendants and that it waa was issued by the judge and not by the court ganahl offered no authorities but seemed to attack atack the power of the court all along the line in pursuance of intimations thrown out by the dispatches from front north idaho idabo tor for the past four weeks judge ragan made a vigorous reply demanding to know what were the acts from which the defendants were enjoined they were enjoined from doing violence intimidation unlawful interference with the property of others by irresponsible men and combinations bi he ile challenged the tile defendants to show a single case where the law allowed any set of men to do each acts the court promptly denied the motion to dissolve and said that the duty of the court required that all the facts be brought out recited lie cited judge field as authority for issuing the injunction offered to read numerous affidavits in evidence to which lilagan objected aa as the papera papers had not been shown to him beatty again sustained alagan and canahl finally submitted the affidavits to him judge judg beatty said aid that no practice or sub ster fuge should prevent him from getting at the facts concerning thia this case if it took him all summer the court was very emphatic on this point and will probe these matters to the bottom llo will not continue nor dissolve the present injunction till all the facts are laid before him tomorrow judge ilagan will apply to have time to rebut the affidavits served upon him but would not say what his course would be until he had carefully read all the affidavits it leaks out now that the defendants do not deny tho tile outrages perpetrated on pipkin and wolf |
