Show V JN difficulty A suit for the foreclosure of a Ws mortgage in may 1884 the salt lake idock company issued bonds of the denomination of 1000 each and the property of the company was mortgaged to le grande young and nicholas greenbeck Gre esbeck as trustees to secure their payment the bonda provide that in case default is made in payment of any half years inter eston est on any obeaid bonds and such default should continue for eix months at the request of a majority of the holders of the bonds then outstanding the trustees shall declare the whole of the principal of said bonds due and payable the installment of interest which became duo on january ast 1st 1885 is detill unpaid le grande young the surviving trustee brings suit against the rock company tor a foreclosure of this cortage mor tage thomas marshall S P and lorin farr are made defendants and the plaintiff prays that the deed of trust exe buted to them be decreed a second and subordinate lieu on said property the appointment of a re to take charge of the property of the rock company is also prayed for marshall and farr held a deed of trust of the salt lake and fort douglass railway to escure payment of bonds in the sum of which were issued at a time prior to may 1884 |
