Show THE USUAL mckay waxes wroth at tle course taken by a Wl yesterday afternoon arf salt lake city J W in mckays court to answer to the charge of lul cohabitation several witnesses were examined but nothing of importance was obtained but says the salt lake herald tho interest of abo occasion began when eliza schafer the alleged second wife of the defendant way called and sworn in reply to questions put by the prosecution she stated sho was riot mr snella wife mr varian who managed tho caso in the absence of hia chief intimated that this was merely an evasion that the witness probably hoped to escape by swearing she was not a wife meaning a legal wife but the question was araa she any wife be thereupon asked her whether she had ever been married to mr snell she replied that she declined to answer the question mr varian took a few minutes for consideration and then propounded the following queries in writing did you meet art john W snell twelve years ago in tho endowment house and did you enter into any covenants or obligations ol 01 any kind with him there did you ever at any time meet mr john W snell the defendant in tho endowment house and icso did you then and there in any way or in accordance with any form or ceremony promise to be hia wife plural celestial or otherwise did you ever at any place or time or under any circumstances agree to marry john W snell did you ever at any time or place agrio with mr snell to live with him as his wife have you lived with mr snell in the relation of wife have you ever occupied the same bed with him icso during what time la he not your husband and aro you not his wife in plural or celestial marriage as known to the mormon church have you and he not been living together in the relation of husband and wife in plural or celestial marriage during the past three s years mr kirkpatrick i objected to these questions the commissioner said he would rule out all except the ath and ath as being too definite these two he thought competent and proper and he put them again to the witness but she again responded 1 I decline to answer the commissioner therefore waxe d wroth and delivered himself something after hia fashion 1 I regret that it is always women who are pushed forward and advised as I 1 know the woman has been advised in this case to withstand the authority ot the court it is not for me cosay at this stage whether I 1 chink sufficient reason has been shown to hold the defendant for trial but I 1 have held the questions to be proper and I 1 shall certainly inflict a penalty if they are not answered mr kirkpatrick interposed that mr snell said the witness was acting without any advice whatever from him the commissioner replied that he had not meant to say that this particular lady had been so advised but waxing warm again certain contemptible sneaks have advised women to refuge to answer questions in these prosecutions and I 1 want it understood that such a course will not affect this court in imposing punishment upon those who take that meana of resisting it mr varian announced that he wished to assume his ficare in the responsibility in the matter and he would therefore that the witness be committed until ehe mado up her mind to make answers to the questions the defendant was bound over in 1000 to appear on Monday |
