Show BRIGHT 1 ii arraigned on the illegal voting an ejectment suit InT rocress the case of the 0 P R R co vs L B adams and N shilling was brought to trial this morning marshall royle appeared lor the plaintiffs plain tiffi and hon P H emerson and kimbau heywood represented the defendant counsel for the prosecution had stated to the court that they would waive a jury but the defense objected and a jury was paneled em is brought to obtain an ejectment and damages against the defendants whom plaintiffs allege have taken possession of certain lands in box elder conaty which they allege is their property under a congressional grant the prosecution introduced as evidence the act of california in corp orating the C P railroad an act authorizing relocation of said road an extract from the report of the commissi oner on railroads an act of authorizing the building of the road from the state ef california eastward the introduction of a certified copy of tho articles of association of the company was opposed by the defense on the ground that they were not properly certified to as required by the statutes of the territory his hony decided to admit them pro forma with the understanding that he would give the matter further consideration the articles of incorporation and amalgamation were also admitted under the same condition recess until 2 pm chas appeared in court this afternoon and was arraigned on the charge of illegal voting at the november election in 1882 mr wright plead Nor guilty of the charge in the indictment and bail was fixed in the sum of J M langsdorf and N montgomery furnished bonds mr wrights plea was afterwards withdrawn and the statutory time in which to plead was taken the case of the C P co vs adams et al was continued and numerous other documents showing the right of ownership to the land by the railroad company were introduced as evidence to prove that the defendants had occupied the land and fenced it at the time of our going to press this case was still in progress |
